Second Reading of Bills

 

 

Senate Bill No. 29, entitled

A bill relative to the borrowing of money and the issuance of certain debt and securities; to provide for tax levies and sinking funds; to prescribe powers and duties of certain departments, state agencies, officials, and employees; to impose certain duties, requirements, and filing fees upon political subdivisions of this state; to authorize the issuance of certain debt and securities; to prescribe penalties; and to repeal acts and parts of acts.

Was read a second time, and the question being on the adoption of the proposed substitute (H-1) previously recommended by the Committee on Tax Policy,

The substitute (H-1) was adopted, a majority of the members serving voting therefor.

 

Reps. Pappageorge and Basham moved to amend the bill as follows:

1. Amend page 9, line 16, after the first "judgment" by striking out the balance of the line through line 18.

2. Amend page 9, line 19, after "year." by inserting "For purposes of this subdivision, the department may determine that a court order or judgment to levy a tax is not material if it did not have an adverse financial impact on the municipality.".

3. Amend page 10, line 18, after "exceed" by striking out "15%" and inserting "18%".

4. Amend page 17, following line 4, by inserting:

"(8) A municipal security may bear no interest and appreciate as to principal amount if it meets the requirements of subsections (3), (4), and (6). The accreted principal amount of a municipal security shall be considered interest and shall be within the interest rate limitations provided in subsection (1).".

5. Amend page 36, following line 15, by inserting:

"(5) A municipal security issued by a school district that is sold in accordance with a federal program in which the holder of the municipal security, as a result of holding the municipal security, may declare a credit against a federal tax is exempt from the provisions of subsection (1) if the school district deposits in trust payments to provide for the repayment of the municipal security and the first required payment shall occur not later than 5 years after the date of issuance and each required payment in any year after 4 years from the date of issuance shall not be less than 1/5 of the total required payment in any subsequent year.".

6. Amend page 47, line 3, after "security." by striking out "Also, a" and inserting "A".

7. Amend page 47, line 6, after "pledge." by inserting "Refunding securities for outstanding securities issued under the revenue bond act of 1933, 1933 PA 94, MCL 141.101 to 141.140, shall be secured by the same pledge as the outstanding securities being refunded.".

8. Amend page 47, line 16, after "department." by inserting "However, when a municipality is issuing refunding securities for outstanding variable interest rate securities, as determined by the department the net present value calculation shall use the appropriate current fixed interest rate and the fixed interest rate that would have been available for the outstanding variable interest rate securities when originally issued if the outstanding variable interest rate securities had been issued as fixed interest rate securities or shall use another procedure determined by the department.".

9. Amend page 50, line 6, after "used" by striking out the balance of the subsection and inserting "in the following order of priority:

(a) To pay other outstanding unlimited tax full faith and credit municipal securities.

(b) To pay other outstanding limited tax full faith and credit municipal securities.

(c) To be deposited in the general fund of the municipality.".

The motion prevailed and the amendments were adopted, a majority of the members serving voting therefor.

A resolution honoring and thanking J. Allan Larsen.

Whereas, With deep appreciation of the diversity of talents that must come together for educational excellence to be possible, we honor Mr. J. Allan Larsen upon the occasion of his retirement. As Mr. Larsen brings to a close his service as Principal of Saginaw's Heritage High School, we add our voice of thanks to those of the teachers, students, and parents throughout this community; and

Whereas, As anyone who has spent much time around the process of education can attest, there are fewer endeavors more complex than education. The old African adage, "It takes a whole village to educate a child," certainly rings true, even in this age of computers and the Internet. Teachers, administrators, building personnel, lunch aides, bus drivers, learning assistants, and specialists all have important roles to play in helping young people become motivated and productive students. Each of these people, in turn, serves to complement the work started at home by parents and family; and

Whereas, In his work as a teacher, administrator, and principal over the past 34 years, Mr. Larsen has been part of this challenging task. With his heartfelt concern for young people and the realization of the importance of learning in our swiftly changing world, Mr. Larsen has helped countless students and strengthened our state and its future; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body honor and thank J. Allan Larsen for his commitment to the young people of Heritage High School and the community of Saginaw. May his retirement be filled with health and happiness; and be it further

Resolved, That a copy of this resolution be transmitted to J. Allan Larsen as a token of our esteem.

House Resolution No. 149.

A resolution observing the week of September 17-23, 2001, as Pollution Prevention Week in Michigan.

Whereas, Pollution prevention is being promoted as a priority in achieving environmental quality in the state of Michigan in a week of observance, education, and outreach. The people of Michigan are proud of our state's beauty, natural resources, and environment; and

Whereas, The presence of pollutants may pose a threat to our environment, public health, and safety. Pollution prevention is a fundamental approach protecting the environment and maintaining the health and safety of workers in the workplace by stopping pollution before it occurs. This can benefit businesses by increasing industrial efficiency through process and material waste reduction, thereby saving businesses time and money; and

Whereas, By a proactive approach to pollution prevention, Michigan can meet the challenges of having both a sustainable environment and a healthy economy for its citizens and businesses; and

Whereas, The passage of the Clean Michigan Initiative bond fund has provided valuable new funding for pollution prevention activities and will result in greater citizen awareness and support for pollution prevention throughout the state; and

Whereas, Pollution Prevention Week is an opportunity for the people of Michigan to join together for a clean and vibrant Michigan by taking action in promoting the reduction of waste at its source. It is also an opportunity to identify where it is not feasible to reuse or recycle waste; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body observe the week of September 17-23, 2001, as Pollution Prevention Week in Michigan and encourage all businesses and community members to participate in local and regional celebratory and educational activities; and be it further

Resolved, That a copy of this resolution be transmitted to the organizers of this event as evidence of our respect and esteem.

Substitute for House Resolution No. 49

A resolution to express support for measures that would strengthen the legal basis for halting Great Lakes water diversion by granting the Great Lakes states the specific authority to prevent water from being transported or exported out of the Great Lakes Basin.

Whereas, In 1985, the eight Great Lakes governors and the premiers of Ontario and Quebec entered into an agreement designed to safeguard the waters of the Great Lakes. Known as the Great Lakes Charter, this agreement set standards of use and cooperation that are vital to the long-term health of the lakes; and

Whereas, Over the years, there have been a variety of threats to divert water from the basin. Most observers, noting the dramatic and ever-increasing shortages of fresh water elsewhere and the advances likely to be made in technologies, feel that the future will bring more interest in water diversion strategies; and

Whereas, In reaction to past, present, and future threats to the lakes, the states of the Great Lakes Basin are working on a new agreement, known as Annex 2001. This agreement is based, in part, on the recommendations of the International Joint Commission following its study of Great Lakes water. The central aim of the agreement is to strengthen the authority of the Great Lakes governors and assure that the control over large water exports and diversions of Great Lakes water remains the responsibility of the Great Lakes states; now, therefore, be it

Resolved by the House of Representatives, That we express support for measures that would strengthen the legal basis for halting Great Lakes water diversion by granting the Great Lakes states the specific authority to prevent water from being transported or exported out of the Great Lakes Basin; and be it further

Resolved, That copies of this resolution be transmitted to the governors of the Great Lakes states and to the Michigan Department of Environmental Quality, Office of the Great Lakes.
