I am submitting a list of nineteen research projects approved for funding under the Michigan Great Lakes Protection Fund in compliance with Act 156 of the Public Acts of 1989. Section 10.(1) of the Act requires that this list be submitted annually to the legislature.
These projects were recommended by the Michigan Great Lakes Protection Fund Technical Advisory Board after extensive review. Funding for these projects was approved under the Department's FY 2000 and FY 2001 appropriations. Also enclosed is a listing of the criteria used in assigning priority to the projects.

A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 2006 (MCL 500.2006).
Recommends:
First: That the House recede from the Substitute of the House as passed by the House.
Second: That the Senate and House agree to the Substitute of the Senate as passed by the Senate and to the following amendments:
1. Amend page 4, line 21, after "FACILITIES" by inserting "THAT ARE NOT PHARMACIES AND".
2. Amend page 4, line 24, after "COMMISSIONER" by striking out "OF INSURANCE".
3. Amend page 5, line 14, after "SERVICES" by inserting "FOR AN ELIGIBLE INDIVIDUAL".

A bill to amend 1956 PA 218, entitled "An act to revise, consolidate, and classify the laws relating to the insurance and surety business; to regulate the incorporation or formation of domestic insurance and surety companies and associations and the admission of foreign and alien companies and associations; to provide their rights, powers, and immunities and to prescribe the conditions on which companies and associations organized, existing, or authorized under this act may exercise their powers; to provide the rights, powers, and immunities and to prescribe the conditions on which other persons, firms, corporations, associations, risk retention groups, and purchasing groups engaged in an insurance or surety business may exercise their powers; to provide for the imposition of a privilege fee on domestic insurance companies and associations and the state accident fund; to provide for the imposition of a tax on the business of foreign and alien companies and associations; to provide for the imposition of a tax on risk retention groups and purchasing groups; to provide for the imposition of a tax on the business of surplus line agents; to provide for the imposition of regulatory fees on certain insurers; to modify tort liability arising out of certain accidents; to provide for limited actions with respect to that modified tort liability and to prescribe certain procedures for maintaining those actions; to require security for losses arising out of certain accidents; to provide for the continued availability and affordability of automobile insurance and homeowners insurance in this state and to facilitate the purchase of that insurance by all residents of this state at fair and reasonable rates; to provide for certain reporting with respect to insurance and with respect to certain claims against uninsured or self-insured persons; to prescribe duties for certain state departments and officers with respect to that reporting; to provide for certain assessments; to establish and continue certain state insurance funds; to modify and clarify the status, rights, powers, duties, and operations of the nonprofit malpractice insurance fund; to provide for the departmental supervision and regulation of the insurance and surety business within this state; to provide for regulation over worker's compensation self-insurers; to provide for the conservation, rehabilitation, or liquidation of unsound or insolvent insurers; to provide for the protection of policyholders, claimants, and creditors of unsound or insolvent insurers; to provide for associations of insurers to protect policyholders and claimants in the event of insurer insolvencies; to prescribe educational requirements for insurance agents and solicitors; to provide for the regulation of multiple employer welfare arrangements; to create an automobile theft prevention authority to reduce the number of automobile thefts in this state; to prescribe the powers and duties of the automobile theft prevention authority; to provide certain powers and duties upon certain officials, departments, and authorities of this state; to repeal acts and parts of acts; and to provide penalties for the violation of this act," by amending section 2006 (MCL 500.2006).

"(E) ASSURANCE THAT, IF THE PERSON OR ENTITY KNOWS OR LEARNS THAT AN INDIVIDUAL IT EMPLOYS OR CONTRACTS TO SERVE AS A SUBSTITUTE TEACHER UNDER THIS SECTION HAS BEEN CONVICTED OF A CRIME DESCRIBED IN SECTION 1535A(1), THE PERSON OR ENTITY WILL IMMEDIATELY NOTIFY THE SCHOOL DISTRICT OR INTERMEDIATE SCHOOL DISTRICT IN WHICH THE INDIVIDUAL IS PLACED AND THE DEPARTMENT OF THE CONVICTION.".

Senator Peters offered the following amendment:
1. Amend page 2, following line 21, by inserting:
"Sec. 1233. (1) Except as otherwise provided by law, the board of a school district or intermediate school board of an intermediate school district shall not permit a teacher who does not hold a valid teaching certificate to teach in a grade or department of the school.
(2) The board of a school district or intermediate school board of an intermediate school district shall not allow an individual to serve in a counseling role in the school district or intermediate school district, as the role is defined by the superintendent of public instruction, unless the individual meets 1 or more of the following and the board or intermediate school board complies with subsection (7):
(a) The individual holds a valid teaching certificate with a school counseling endorsement.
(b) The individual meets all of the following:
(i) Holds a master's degree awarded after completion of an approved school counselor education program that includes at least all of the following skills and content areas or their equivalent:
(A) Guidance service--philosophy, principles, and practices.
(B) Individual and group analysis--nature and range of human characteristics and appraisal methods.
(C) Guidance information--vocational development theory, educational and occupational information.
(D) Counseling theory and practice--individual and group procedures, administration and coordination relationships, professional relationships, and ethics.
(E) Supervised experiences--laboratory, practicum, or internship.
(F) Evaluation--statistics and research methodology, follow-up evaluation, and measurement methods.
(ii) Has successfully completed the department's guidance counselor examination.
(iii) Has been recommended by an approved school counselor education program to provide services as a school counselor.
(c) The individual meets both of the following:
(i) Has at least 5 years of successful experience serving in a school counseling role in another state within the immediately preceding 7-year period.
(ii) Has successfully completed the department's guidance counselor examination.
(3) The intermediate superintendent shall notify the superintendent of public instruction immediately of the names of noncertificated teachers teaching in violation of subsection (1) and the names of individuals serving in counseling roles in violation of subsection (2), the employing district, and the amount of time the noncertificated teachers or unqualified individuals were employed.
(4) A vocational teacher preparation institution shall utilize the employment experience of an annually authorized teacher for the purpose of waiving student teaching as a requirement for vocational certification if the annually authorized teacher is supervised by the teacher preparation institution.
(5) All vocational education teachers certified after June 1, 1995 shall pass a competency test.
(6) The EXCEPT AS OTHERWISE PROVIDED IN THIS SUBSECTION, THE board of a school district or intermediate school district may employ a person without a teaching certificate as a substitute teacher if the person has at least 90 semester hours of college credit from a college or university. BEGINNING JULY 1, 2001, THE BOARD OF A SCHOOL DISTRICT OR INTERMEDIATE SCHOOL DISTRICT MAY EMPLOY A PERSON WITHOUT A TEACHING CERTIFICATE AS A SUBSTITUTE TEACHER ONLY IF THE PERSON HOLDS A SUBSTITUTE TEACHER PERMIT ISSUED BY THE DEPARTMENT. THE DEPARTMENT SHALL ISSUE A SUBSTITUTE TEACHER PERMIT ONLY TO A PERSON WHO HAS AT LEAST 90 SEMESTER HOURS OF COLLEGE CREDIT FROM A COLLEGE OR UNIVERSITY AND HAS PASSED A SUBSTITUTE TEACHER TEST DEVELOPED OR SELECTED BY THE DEPARTMENT. NOT LATER THAN MAY 1, 2001, THE DEPARTMENT SHALL DEVELOP APPLICATIONS AND PROCEDURES FOR ISSUANCE OF A SUBSTITUTE TEACHER PERMIT AND SHALL DEVELOP OR SELECT A SUBSTITUTE TEACHER TEST FOR THE PURPOSES OF THIS SUBSECTION.
(7) If the board of a school district or intermediate school board of an intermediate school district chooses to employ an individual who does not hold a valid teaching certificate to serve in a counseling role, as permitted under subsection (2), the school board or intermediate school board shall comply with sections 1230 and 1230a with respect to that individual to the same extent as required for employing a person with a teaching certificate to serve as a teacher.".

A resolution to designate October 4, 2000, as Jeff Daniels Day in the state of Michigan.
Whereas, Jeff Daniels was raised in the state of Michigan and has significantly contributed to the promotion of the arts in Michigan; and
Whereas, Daniels attended Central Michigan University, majoring in English and minoring in theatre. After winning the lead role in Tennessee Williams' Summer and Smoke and Lanford Wilson's The Hot L Baltimore, Daniels was invited to join the Circle Repertory Company in New York; and
Whereas, He moved to New York in the fall of 1976, where he starred in numerous plays including The Farm and Gemini. In 1983, Daniels won the Obie Award for Johnny Got His Gun; and
Whereas, Jeff made his feature film debut in Milos Foreman's Ragtime. His first popular success came with his next project Terms of Endearment, and next came two leading roles, one of which was in Woody Allen's The Purple Rose of Cairo. Working with Woody Allen was a turning point in Daniels' career, and so much so, he named his theatre company after the film; and
Whereas, In 1991, Daniels established the Purple Rose Theatre Company, a nonprofit professional theatre featuring Midwestern actors, directors, playwrights, and designers, located in Chelsea, Michigan; and
Whereas, Over the past nine years, the Purple Rose Theatre has gained a national reputation as a home for new American plays and recently shared the American Critic Association's 1998 Best New American Play with Lanford Wilson for his play Book of Days; and
Whereas, Jeff Daniels has written several plays for the Purple Rose Theatre, including his first play Shoe Man which won the Detroit News 1990-91 Best New Play Award. Among other plays, Daniels has written: The Tropical Pickle (1992), The Vast Difference (1993), The Kingdom's Coming (1994), Apartment 3A (1996), Boom Town (1998), and the soon-to-be released Across the Way (2000); and
Whereas, Jeff has recently formed a Michigan-based film production company as an outlet for his desire to act, write, and direct his own films. An independent film of his screenplay Escanaba in da Moonlight was recently shot on location in Michigan. This most popular play, now film, is a wild comedy set in an Upper Peninsula deer camp; and
Whereas, Jeff Daniels has been a professional stage and film actor for 22 years and has committed his skills and talents to promoting the arts in Michigan; now, therefore, be it

A resolution to honor the University of Michigan Medical School on the celebration of its Sesquicentennial Anniversary.
Whereas, The University of Michigan Medical School celebrates its Sesquicentennial Anniversary this year; and
Whereas, The University of Michigan Medical School matriculated its first class in 1850. In 1869, it established the first university-owned teaching hospital which served as a model for academic medical centers across the nation. The Medical School was also one of the first to admit women and minorities in the 1870s; and
Whereas, The development of a medical curriculum grounded in science was pioneered by the University of Michigan Medical School. Their clinical teaching program became a model for U.S. medical schools; and
Whereas, As the first professional school at the University of Michigan, the Medical School has awarded over 18,000 M.D. degrees in the past 150 years and has also educated thousands of medical residents and biomedical researchers; and
Whereas, The Medical School is recognized for its state-of-the-art research, innovative medical education, and pioneering clinical care; and

Senator Byrum's statement is as follows:
I rise today to express my extreme disappointment in the low enrollment numbers for this state's children's health insurance program, MIChild. Although we created this program over two years ago and although there were 156,000 children who were expected to be eligible for the program at that time, as of August 1, 2000, there were only 13,209 children enrolled in the program. This number is disappointingly low. As a result of this very low number, Michigan just returned $41 million to the federal government--money that the federal government had given us to insure our children. Yet because we failed to do an adequate job, we had to return the money. This money will now be divided among the states that did a good job at enrolling their uninsured children.
It is time that we demand a successful program. We know that we still have approximately 100,000 children in this state who do not have health insurance. We should make enrolling these children in the MIChild program a top priority. It is absurd that the private enrollment broker for the MIChild program receives almost $3 million each year and yet is not held accountable for its results. Because of this low enrollment number this, private enrollment broker is receiving approximately $220.00 for every child it enrolls.
There are many more efficient ways to spend this $2.9 million, and it is my hope that we begin to pursue them. As lawmakers it's time that we demand improved success with the MIChild program. We should not return one more penny to the federal government and instead should be spending all of the money given to us to provide health care for uninsured children.

Senator Miller's statement is as follows:
The reason I missed those votes, my floor leader mentioned how I had to be--didn't have to be, I wanted to be--at a funeral for a very good friend of mine. I wish the members of this body would have had the opportunity to meet Ray Blake. He was a young man who was 52 years old. He was a man who grew up in northern Macomb County on a farm. I had a chance to meet this young man back in the '60s when we were both young people.
Ray Blake was a great man. He was a young man who happened to come down with cancer after the first of the year. Many people in southeast Michigan drink Blake's cider and eat his apples. He was a determined man, Governor. He traveled from hospital to hospital, determined to find a cure to this terrible, terrible disease.
He was a man who not only grew up on a farm in a small town of Armada in northern Macomb County, but he was a man who grew up with 11 brothers and sisters, and his father and his mother farmed this farm. You know yourself being a farmer that things get awful tough during farming, and his father contemplated selling that farm. Ray Blake went on from graduating from Armada High School to Michigan State University to earn a degree in business and horticulture. He came back to that family farm, and Governor, he saved that family farm. He brought his brothers together, and they formed a partnership. Through his education at Michigan State, he learned new farming techniques. He had vision. He took that orchard that was almost sold for firewood and turned it into one of the best orchards in the state of Michigan. He served for the Governor on the Apple Commission.
He was a young man who had vision. He and his brothers, who were his co-partners, worked to turn that farm around. He had values, Governor. He had values for not only all the hundreds of people who worked for him, but he had values for his wife, Jan, and for his two sons and his daughter, who happened to all have graduated like him not only from Armada High School, but they have green and white and all went to earn degrees from Michigan State.
I missed those votes, and I'd miss them every day because Ray Blake is the kind of guy who you hear about in the textbooks and read about in the storybooks who grew up in rural America, rural Michigan, and went on to change the values for his family and all the friends he had. I think everybody this morning, Mr. President, was at that funeral. The town of Armada was very, very solace for the loss of Ray Blake.
Michigan's going to lose him. His family, certainly, has already expressed a loss for him, and I'm going to lose him as a great, great friend--a man who was quiet, but he had leadership and he had vision that could see off into the future. He not only grew apples, but he grew the best sweet corn, the biggest pumpkins, and the best strawberries in Macomb County. I want to say I'd miss these votes every day if I had a chance to say my final good-bye to a man who I thought was just a tremendous person. We're going to miss him, and everybody in Michigan is going to miss him, especially his family. God bless Ray Blake.
Senator Stille's statement is as follows:
I will be absent tomorrow for much the same reason as Senator Miller spoke about his absence earlier. I will be attending a service for a young man who left quite a mark on the state of Michigan. He, too, was 52 years old. Pete Schmidt was the head coach of Okemos High School for some eight years, went on to Albion College, and brought back to the state of Michigan one of the only national championships brought back to Michigan by any college or college coach here in the state when his team won the national champion for Division 3 back in 1994.
Pete went on to be an assistant head coach at the University of Indiana, and he succumbed last Friday to Hodgkins disease lymphoma. He came down with the disease last October and had a valiant struggle for almost a year and passed away last Friday. He is the father of my daughter-in-law, he has become a very close friend and needless to say, this was a rather emotional weekend.
Pete will leave his mark on many families across Michigan as he touched the life of many, many athletes at Okemos, at Albion College, and at the University of Indiana. Without a doubt, he would have been a head coach for a major college here in the state of Michigan had he not been attacked by this vicious disease.
He leaves behind magnificent family, Becky his wife of some 30 years, daughter Amy, daughter Sarah, son Peter, and two sons-in-law Randy and Rob. I am extremely proud to be part of that family and will be extremely proud to honor him tomorrow as much of the Michigan athletic family, as well as those who were touched by his contacts through the years will honor him tomorrow in Albion.
Senator McCotter's statement is as follows:
I just wanted to extend my personal condolences to the people of Canada. As many of us know, the 15th prime minister in the history of Canada recently died, Pierre Elliot Trudeau, at the age of 80 this weekend.
It just seems to me that at a time when so many people in public life tend to be accused of being shallow, ungenuine, and self-serving, a person of Pierre Elliot Trudeau's stature is a lesson and a point of pride not just to the people of Canada, but to all of us who engage in public service. He will be missed, and I doubt he will ever be replaced.
Senator Johnson's statement is as follows:
I, too, would rise to address the issue of the loss of federal dollars with respect to MIChild. I'm an individual legislator from the House who took part in very lengthy negotiations attempting to put together a program that we believed sincerely would be attractive to every parent at a low income to provide health care for their children. At $5.00 a month it seemed, to me, to be a pretty fantastic insurance policy.
But one of the things I think all of us have to recognize as we deal with these issues under this dome is that life does not always offer that $5.00 opportunity. It was believed by those of us who participated in that effort that by allowing there to be a small co-pay, it would be more attractive. I had many years ago spent some time on Oakland County's Community Development Advisory Board--as matter of fact, I chaired it for many years. I was brought in and asked to chair that because at that time the community board did not have any provisions for low-income people; they wanted to spend those federal dollars on soil surveys. We were at a peak where we were about to lose all those federal dollars, so we decided that people were not applying for them because a) they didn't know about them, and b) they didn't want government to take the title from their home and hold it until the deal was over. So we offered a small co-pay, and we were amazed at the amount of people who flocked to it.
We believed at that time, when we dealt with MIChild, by having a small, a very low co-pay and the option when you applied to indicate that you couldn't afford it would open the gates and we would just swell--the program. That didn't happen. Why it didn't happen, I think, as I started to say earlier that as we deal with things under the dome, we tend to forget what life is really like when one is trying to stretch that almighty dollar from paycheck to paycheck and sometimes not even a paycheck, but from dollar to dollar. And often what gets left behind are the children's health care. It's unfortunate, but it is not a slap on our faces. We did everything we could to provide this program for those kids. We just have to do better next time around.

Senator Rogers' statement is as follows:
I am introducing this resolution, along with Senator Hoffman, to recognize October as Children's Internet Safety Month. We are all aware, especially as our children have begun a new school year, the Internet is one of the most effective tools in education and research. It can also be a dangerous means for predators to contact our children, and we need to be vigilant in promoting Internet safety awareness.
A great deal of legislation that I have sponsored in the past two years has dealt with Internet safety. As a result, we now have laws in Michigan prohibiting use of the Internet to contact minors for criminal sexual conduct and stalking, and as of October 1, 2000, Michigan libraries are required to prevent minors from accessing pornography on-line.
Instant global communication is a challenge for parents, schools, and government. The amount of material out there is staggering, and much of it can be harmful to children. Senator Hoffman and I are introducing this resolution to support and commend groups like Freedom ISP that are working to protect children on-line by developing advanced filtering systems. These systems give parents the means to protect their children from pornography and predators on-line.
