Reverend Douglas Jackson, from the Community Baptist Church in Saginaw, offered the following invocation:

 

"Our Gracious Heavenly Father, I thank You for our great state and the wonderful freedom we enjoy in America. I thank You, Father, for the opportunity we have to have this House. I pray, Father, You bless it. Amid the confusion and conflict in our world today, we thank You for being an orderly, unchanging God where we can find our security. Dear God, our hearts are saddened, our stomachs are sickened, as we continue to hear about the horrific school killings in Littleton, Colorado. Father, please help the families that have suffered loss. Father, I pray that You be with that community in a very special way. As we look at our world, our hearts also go out to the refugees and families that have suffered great loss in Kosovo. We pray for the safety of our POWs and Michigan's very own staff sergeant, Christopher Stone. Dear God, protect every soldier that is involved in this conflict for humanity. At this session, as it opens, I pray that each representative will honor You with the plans that they approve and the decisions they make. May we have a resurgence in honesty, integrity, and the furtherance of truth. I pray for our state leadership. I pray that they be sensitive to Your Sovereignty. Dear Lord, please continue to bless the leadership of Representative Howell and his colleagues as they honor You and America. In Jesus' name. Amen."

A resolution honoring Friends In Deed.

Whereas, Friends In Deed has been providing useful services to low income, handicapped, and otherwise disadvantaged Michiganders since 1983. This agency is the help source of last resource for many Ypsilanti area residents who are under increased working pressure; and

Whereas, Friends In Deed provides many services other agencies in the Ypsilanti area do not, and has been recognized as a valued partner to government agencies in the Ypsilanti-Ann Arbor area; and

Whereas, In 1999, Friends In Deed faces daunting new challenges as they strive to cope with increased costs while working to meet the needs of Ypsilanti residents; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body urge Michiganders to support Friends In Deed in its charitable work; and be it further

Resolved, That a copy of this resolution be presented to Friends In Deed as evidence of our highest esteem and appreciation of their efforts for services rendered to citizens in need.

Pending the reference of the resolution to a committee,

Rep. Raczkowski moved that Rule 77 be suspended and the resolution be considered at this time.

The Committee on Insurance and Financial Services, by Rep. Sanborn, Chair, reported

House Resolution No. 30.

A resolution to oppose the proposed federal "Know Your Customer" banking regulation and to urge certain federal agencies and the Congress of the United States to refrain from requiring transaction screening practices that threaten personal privacy.

(For text of resolution, see House Journal No. 19, p. 272.)

With the recommendation that the following substitute (H-1) be adopted and that the resolution then be adopted.

Substitute for House Resolution No. 30.

A resolution to oppose "Know Your Customer" banking regulations and policies and to memorialize the Congress of the United States to enact legislation to prohibit banking transaction screening practices that threaten personal privacy.

Whereas, The Federal Deposit Insurance Corporation (FDIC), the Board of Governors of the Federal Reserve System, the Office of the Comptroller of the Currency, and the Office of Thrift Supervision have been considering a proposed rule known as the "Know Your Customer" regulation. Although currently withdrawn from formal consideration through the federal regulatory process, this proposed measure would require banks and savings institutions to develop and enforce programs to monitor banking transactions to identify those that may be connected to certain illegal activities; and

Whereas, The "Know Your Customer" concept is a response to concerns over activities such as money laundering, drug trafficking, tax evasion, and fraud. The regulation places an enormous burden of responsibility on banks, while ignoring the fact that provisions already exist to help deal with suspicious banking activities; and

Whereas, In addition to the proposed rule, which prompted overwhelming objections during the public comment period, federal banking officials already require banks to have "Know Your Customer" guidelines and procedures in place to identify suspicious activities. The Federal Reserve Bank's Secrecy Act compliance manual specifies this policy and directs bank examiners to look for compliance with this practice; and

Whereas, The "Know Your Customer" concept represents a serious threat to the privacy of law-abiding citizens. Giving the banks the duty of monitoring all banking transactions--without probable cause and appropriate search warrants--is a clear threat and likely violation of the Fourth Amendment, which states, in part, the right of the people to be secure in their papers and effects against unreasonable searches and seizures. The "Know Your Customer" concept ignores constitutional protections of personal privacy; and

Whereas, There is legislation currently pending in Congress to prohibit "Know Your Customer" transaction screening policies. This type of legislation, to protect personal privacy under the Fourth Amendment, is most appropriate; now, therefore, be it

Resolved by the House of Representatives, That we oppose "Know Your Customer" banking regulations and policies and memorialize the Congress of the United States to enact legislation to prohibit banking transaction screening practices that threaten personal privacy; and be it further

Resolved, That copies of this resolution be transmitted to the Federal Deposit Insurance Corporation, the Board of Governors of the Federal Reserve System, the Office of the Comptroller of the Currency, the Office of Thrift Supervision, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

The Speaker announced that under Rule 77 the resolution would lie over one day.
