A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 314 (MCL 257.314), as amended by 1989 PA
299.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 314. (1) Except as
OTHERWISE provided in subsections
2 (2), (3), (4), (5), and (6)
THIS SECTION, an operator's license
3 shall expire on the birthday of the person to whom the license is
4 issued in the fourth year following the date of the issuance of
5 the license unless suspended or revoked before that date or
6 issued pursuant to section 314b. A license shall not be issued
7 for a period longer than 4 years. A person holding a license at
8 any time within 45 days before the expiration of his or her
9 license may make application for a new license as provided for in
10 this chapter. Beginning

1 1992, a person who has a
license with a class 1, class 2, or
2 class 3 indorsement may
make application for renewal of his or
3 her license 90 days
before expiration of the license. However, a
4 knowledge test for an original group designation or indorsement
5 may be taken at any time during this period and the results shall
6 be valid for 12 months. However, if the licensee will be out of
7 the state during the 45 days immediately preceding expiration of
8 the license or for other good cause shown cannot apply for a
9 license within the 45-day period, application for a new license
10 may be made not more than 6 months before expiration of the
11 license. This new license when granted shall expire as provided
12 for in this chapter.
13 (2) Effective October 1, 1985, the first operator's license
14 issued to a person who at the time of application is less than
15 20-1/2 years of age shall expire on the licensee's twenty-first
16 birthday unless suspended or revoked. The secretary of state
17 shall code the license in a manner which clearly identifies the
18 licensee as being less than 21 years of age.
19 (3) The first chauffeur's license issued to a person shall
20 expire on the licensee's birthday in the fourth year following
21 the date of issuance unless the license is suspended or revoked
22 before that date or is issued pursuant to section 314b.
23 Effective October 1, 1985, the chauffeur's license of a person
24 who at the time of application is less than 20-1/2 years of age
25 shall expire on the licensee's twenty-first birthday unless sus-
26 pended or revoked. The secretary of state shall code the license
27 in a manner which clearly identifies the licensee as being less

1 than 21 years of age. A subsequent chauffeur's license shall
2 expire on the birthday of the person to whom the license is
3 issued in the fourth year following the date of issuance of the
4 license unless the license is suspended or revoked before that
5 date or is issued pursuant to section 314b.
6 (4) A person may apply for an extension of his or her driv-
7 ing privileges if he or she is out of state on the date that his
8 or her operator's or chauffeur's license expires. The extension
9 may extend the license for 90 days beyond the expiration date or
10 within 2 weeks after the applicant returns to Michigan, whichever
11 occurs first.
12 (5) A person who will be out of state for more than 90 days
13 beyond the expiration date of his or her operator's license may
14 apply for a 2-year extension of his or her driving privileges.
15 The applicant for this extension shall submit a statement evi-
16 dencing a vision examination in accordance with the rules promul-
17 gated by the secretary of state under section 309. The fee for a
18 2-year extension shall be the same as provided in section
19 314b(2).
20 (6) A person whose operator's or chauffeur's license is
21 unexpired but whose class 1, class 2, or class 3 indorsement has
22 expired pursuant to section
312e(8) 312E(10) may apply for a
23 vehicle group designation or indorsement. Upon proper applica-
24 tion and payment of the fees
prescribed in section 312g or 314b
25 and section 811, the expiration of the person's operator's or
26 chauffeur's license shall be extended for 4 years beyond the

1 expiration which would have applied except for the operation of
2 section 312e(8)
