A bill to amend 1996 PA 575, entitled "The central disability resource directory act," by amending sections 2, 3, 6, 7, 8, 9, and 10 (MCL 395.322, 395.323, 395.326, 395.327, 395.328, 395.329, and 395.330); and to repeal acts and parts of acts. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2. As used in this act: 2 (a) "Agency" means an organization designated by the gover- 3 nor to implement a program described in section 931 of the mental 4 health code, Act No. 258 of the Public Acts of 1974, being 5 section 330.1931 of the Michigan Compiled Laws 1974 PA 258, MCL 6 330.1931, or a state department, bureau, division, section 7 ADMINISTRATIVE UNIT OF A STATE DEPARTMENT, board, commission, 8 trustee, authority, institution of higher education, or office 9 created by the constitution, statute, or agency action. 04894'99 JJG 2 1 (B) "BUREAU" MEANS THE LEGISLATIVE SERVICE BUREAU CREATED BY 2 THE LEGISLATIVE COUNCIL ACT, 1986 PA 268, MCL 4.1101 TO 4.1901. 3 (C) (b) "Central disability resource directory" or 4 "directory" means the computerized system or other organized mode 5 of keeping a record of all reports filed pursuant to this act. 6 (D) (c) "Commission" means the commission on disability 7 concerns established by Act No. 11 of the Public Acts of 1968, 8 being sections 395.301 to 395.307 of the Michigan Compiled Laws 9 1968 PA 11, MCL 395.301 TO 395.307. 10 (E) (d) "Computer network" means the interconnection of 11 communication lines with a computer through remote terminals or a 12 complex consisting of 2 or more interconnected computers. 13 (F) (e) "Disability" means a determinable physical or 14 mental characteristic of an individual that may result from dis- 15 ease, injury, congenital condition of birth, or functional disor- 16 der if the characteristic limits 1 or more of the major life 17 activities of that individual. 18 (G) (f) "Library" means , except as provided in section 19 7(1)(h), the A library of Michigan created by section 3 of 20 the library of Michigan act, Act No. 540 of the Public Acts of 21 1982, being section 397.13 of the Michigan Compiled Laws OR 22 AUTHORIZED BY ANY LAW OF THIS STATE. 23 (H) (g) "Service provider" means a person, organization, 24 local or state governmental unit, or other entity that receives 25 state or federal money for the purpose of providing services, 26 equipment, supplies, or other assistance to a person with a 27 disability or the family of a person with a disability. 04894'99 3 1 Sec. 3. (1) The commission in consultation with the 2 library BUREAU shall develop and distribute a form to all agen- 3 cies, and all agencies shall complete that form by providing at 4 least the following information on available services provided 5 with state or federal money by a service provider to assist per- 6 sons with disabilities or the families of persons with 7 disabilities: 8 (a) The name of the agency that provides the state or fed- 9 eral money. 10 (b) The name, address, phone number, and contact person for 11 the service provider receiving the state or federal money. 12 (c) A brief description of the services provided by the 13 service provider. 14 (d) Eligibility criteria a person with a disability or the 15 family of a person with a disability must meet before receiving 16 the assistance of that service provider. 17 (2) The commission shall assure that the information is com- 18 plete, suitable for inclusion in the central disability resource 19 directory, and in a form and format easily understood by the gen- 20 eral public. 21 (3) The commission shall distribute forms to update existing 22 data and solicit new information on a continuing basis and com- 23 plete an update of the entire central disability resource direc- 24 tory at least annually. 25 (4) The commission shall first distribute to all agencies 26 the forms described in subsection (1) not more than 180 days 27 after the effective date of this act. 04894'99 4 1 Sec. 6. The commission shall forward to the library 2 BUREAU forms completed pursuant to section 4. 3 Sec. 7. (1) The library BUREAU shall do all of the 4 following: 5 (a) Create AND MAINTAIN a central resource directory of the 6 information from forms forwarded under section 6, and employ a 7 taxonomy USE A SYSTEM in the maintenance of that central 8 resource directory that is consistent with the taxonomy 9 employed SYSTEM USED by federal agencies that maintain data for 10 public use. 11 (b) Train library BUREAU staff to enter and maintain the 12 central resource directory data from the forms forwarded under 13 section 6. 14 (c) Disseminate the information contained in the central 15 resource directory in a manner consistent with this act. 16 (d) Assist persons in obtaining access to central resource 17 directory information. 18 (e) Add new information to the central resource directory 19 within 30 days of receiving that information. 20 (f) Update the entire central resource directory at least 21 annually. 22 (g) Make the central resource directory accessible to an 23 individual who calls or visits the library BUREAU. 24 (h) Establish a computer network for the central resource 25 directory and make the computer network available to any of the 26 following entities that comply with Act No. 1 of the Public Acts 27 of 1966, being sections 125.1351 to 125.1356 of the Michigan 04894'99 5 1 Compiled Laws 1966 PA 1, MCL 125.1351 TO 125.1356, and comply 2 with applicable state and federal laws affecting persons with 3 disabilities, and accommodate persons with disabilities: 4 (i) A public library as defined in section 2 of the state 5 aid to public libraries act, Act No. 89 of the Public Acts of 6 1977, being section 397.552 of the Michigan Compiled Laws 1977 7 PA 89, MCL 397.552. 8 (ii) A library of a college or university described in sec- 9 tion 5 or 6 of article VIII of the state constitution of 1963. 10 (iii) A regional or subregional library designated by the 11 national library service and the library of Michigan to provide 12 services for the blind and persons with disabilities. 13 (iv) Agencies. 14 (2) The library BUREAU may establish computer network 15 guidelines and procedures for those organizations providing serv- 16 ices to persons with disabilities and the families of persons 17 with disabilities and not receiving state or federal money for 18 those services. 19 Sec. 8. The information in the directory system or a writ- 20 ing prepared, owned, used, in the possession of, or retained by 21 the library BUREAU pursuant to this act shall be made available 22 to the public in compliance with the freedom of information act, 23 Act No. 442 of the Public Acts of l976, being sections 15.231 to 24 15.246 of the Michigan Compiled Laws 1976 PA 442, MCL 15.231 TO 25 15.246. 26 Sec. 9. The commission and the library BUREAU shall each 27 file a report annually with the legislature that identifies the 04894'99 6 1 manner in which this act is implemented by the reporting entity 2 and specifies the frequency with which persons use the central 3 disability resource directory through the reporting entity. 4 Sec. 10. The duties imposed upon the commission and 5 library BUREAU under this act shall be suspended in any fiscal 6 year in which the legislature does not appropriate funds neces- 7 sary to implement this act. 8 Enacting section 1. Section 11 of the central disability 9 resource directory act, 1996 PA 575, MCL 395.331, is repealed. 04894'99 Final page. JJG
