SENATE BILL NO. 448

        A bill to amend 1976 PA 451, entitled

   "The revised school code,"

   by amending section 1246 (MCL 380.1246), as amended by 1995 PA

   289.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1246.  (1) A school district, public school academy, or

 2    intermediate school district shall not employ a person as a

 3    superintendent, principal, assistant principal, or other person

 4    whose primary responsibility is administering instructional pro-

 5    grams or as a chief business official unless the person has com-

 6    pleted the continuing education requirements prescribed by state

 7    board rule under subsection  (2)  (3).

 8         (2) A SCHOOL DISTRICT, PUBLIC SCHOOL ACADEMY, OR

 9    INTERMEDIATE SCHOOL DISTRICT SHALL NOT EMPLOY OR CONTINUE TO

 1    EMPLOY A PERSON IN A POSITION DESCRIBED IN SUBSECTION (1) IF THE

 2    PERSON HAS BEEN CONVICTED OF A CRIME LISTED IN SECTION 1539A(1).

 3         (3)  (2)  The state board shall promulgate
             rules establish-

 4    ing continuing education requirements as a condition for contin-

 5    ued employment for persons employed in positions described in

 6    subsection (1).  The rules shall prescribe a minimum amount of

 7    continuing education to be completed within a 5-year period.
