SENATE BILL NO. 309


   February 16, 1999, Introduced by Senators JAYE and GOSCHKA and
        referred to the Committee on Judiciary.



        A bill to amend 1931 PA 328, entitled

   "The Michigan penal code,"

   (MCL 750.1 to 750.568) by adding section 244a; and to repeal acts

   and parts of acts.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         SEC. 244A.  (1) A PERSON SHALL NOT DESECRATE THE FLAG OF THE

 2    UNITED STATES.

 3         (2) A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDE-

 4    MEANOR PUNISHABLE BY IMPRISONMENT FOR NOT MORE THAN 90 DAYS OR A

 5    FINE OF NOT MORE THAN $100.00, OR BOTH.

 6         Enacting section 1.  Sections 244, 245, 246, and 247 of the

 7    Michigan penal code, 1931 PA 328, MCL 750.244, 750.245, 750.246,

 8    and 750.247, are repealed.
