A bill to amend 1963 PA 17, entitled "An act to relieve certain persons from civil liability when rendering emergency care, when rendering care to persons involved in competitive sports under certain circumstances, or when par- ticipating in a mass immunization program approved by the depart- ment of public health," by amending section 5 (MCL 691.1505), as added by 1985 PA 150. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 5. (1) A block parent volunteer OR PLAYGROUND 2 ATTENDANT who in good faith and while acting as a block parent 3 volunteer OR PLAYGROUND ATTENDANT renders assistance to a minor 4 during an emergencyshallIS notbeliable for civil damages 5 resulting from an act or omission in the rendering of that 6 assistance, except an act or omission amounting to gross negli- 7 gence or wilful and wanton misconduct. 8 (2) As used in this section: 06701'00 GWH 2 1 (a) "Block parent volunteer" means a person who is a member 2 of a nonprofit volunteer organization which has as its primary 3 function assisting minors in getting safely to and from school. 4 (b) "Minor" means a person who is less than 18 years of 5 age. 6 (C) "PLAYGROUND ATTENDANT" MEANS AN INDIVIDUAL WHO, FOR THE 7 PURPOSE OF OVERSEEING THE CHILDREN'S SAFETY, VOLUNTEERS TO 8 OBSERVE CHILDREN WHO ARE ATTENDING SCHOOL DURING A TIME WHEN 9 SCHOOL PERSONNEL ARE NOT DIRECTLY SUPERVISING THE CHILDREN. 06701'00 Final page.
