        A bill to amend 1988 PA 234, entitled

   "Michigan Vietnam veterans memorial act,"

   by amending the title and sections 2 and 5 (MCL 35.1052 and

   35.1055), section 5 as amended by 1992 PA 122, and by adding

   section 5a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

                                    TITLE

 2
           An act to create the Vietnam veterans memorial monument

 3
      fund; to establish a commission to govern the monument fund; to

 4
      prescribe the purpose of the monument fund; to prescribe the

 5
      powers and duties of the commission and certain state departments

 6
      and officers; TO DESIGNATE THE VETERANS MEMORIAL PARK; to provide

 7
      for legislative oversight; and to provide for dissolution of the

 8
      commission and monument fund.

           Sec. 2.  As used in this act:

 2
           (a) "Commission" means the Michigan Vietnam veterans

 3
      memorial monument fund commission established in section 4.

 4
           (b) "Monument fund" means the Vietnam veterans memorial mon-

 5
      ument fund created in section 3.

 6
           (c) "Vietnam veteran" means a veteran of the Vietnam era as

 7
      prescribed in section 1 of  Act No. 190 of the Public Acts of

 8
      1965, being section 35.61 of the Michigan Compiled Laws  1965

 9
      PA 190, MCL 35.61.

           (D) "VETERANS MEMORIAL PARK" MEANS THE VETERANS MEMORIAL

11
      PARK ESTABLISHED IN SECTION 5A.

           Sec. 5.  (1) The commission shall oversee the financing and

13
      construction of a memorial monument dedicated to Vietnam veterans

14
      from Michigan who died or are listed as missing in action as a

15
      result of the Vietnam conflict.  The commission shall solicit

16
      designs for the monument and shall select the final design.

17
           (2) The names of each Michigan Vietnam veteran who died or

18
      is listed as missing in action as a result of the Vietnam con-

19
      flict shall be inscribed on the Vietnam veterans memorial

20
      monument.

           (3) The Vietnam veterans memorial monument shall be located

22
      WITHIN THE VETERANS MEMORIAL PARK on a state owned site  of not

23
      more than  THAT IS A 1-acre  that meets all of the following

24
      criteria:  PARCEL OF LAND WITH A LINE OF SITE OF THE CAPITOL MEA-

25
      SURING APPROXIMATELY 165.44 FEET, IN AN EAST-WEST DIRECTION AND

      APPROXIMATELY 263.30 FEET, IN A NORTH-SOUTH DIRECTION, THE WEST

27
      LINE OF THIS PARCEL TO BE THE EAST RIGHT-OF-WAY LINE OF BUTLER

      loop; thence approximately 840 feet, on the arc of a curve to the
