        A bill to amend 1931 PA 328, entitled

   "The Michigan penal code,"

   by amending section 357b (MCL 750.357b), as added by 1990 PA

   321.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 357b.  (1) A person who commits larceny by stealing the

      firearm of another person is guilty of a felony  , punishable 

 3
      AND SHALL BE PUNISHED by imprisonment for  not more than  5 years

 4
       or by a fine of  AND MAY BE FINED not more than $2,500.00, or

 5
      both.

           (2) A SENTENCE IMPOSED UNDER THIS SECTION SHALL NOT BE

 7
      SUSPENDED.
