A bill to amend 1985 PA 87, entitled "Crime victim's rights act," by amending section 3 (MCL 780.753), as amended by 1993 PA 341. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3. (1) Within 24 hours after the initial contact 2 between the victim of a reported crime and the law enforcement 3 agency having the responsibility for investigating that crime, 4 that agency shall give to the victim the following information in 5 writing: 6 (a) The availability of emergency and medical services, if 7 applicable. 8 (b) The availability of victim's compensation benefits and 9 the address of the crime victims compensation board. 03580'99 JJG 2 1 (c) The address and telephone number of the prosecuting 2 attorney whom the victim should contact to obtain information 3 about victim's rights. 4 (d) The following statement: 5 "If you are not notified of an arrest in your case, you may 6 call this law enforcement agency at [the law enforcement agency's 7 telephone number] for the status of the case.". 8 (2) A POLICE INCIDENT REPORT OF A CRIME THAT IS PREPARED BY 9 A LAW ENFORCEMENT OFFICER SHALL CONSPICUOUSLY INCLUDE A STATEMENT 10 THAT THE INFORMATION REQUIRED TO BE GIVEN TO THE VICTIM UNDER 11 SUBSECTION (1) WAS GIVEN TO THE VICTIM. THE POLICE INCIDENT 12 REPORT SHALL ALSO INCLUDE AN INDICATION WHETHER OR NOT THE VICTIM 13 WISHES TO EXERCISE HIS OR HER RIGHTS PROVIDED UNDER THIS ACT AND 14 UNDER SECTION 24 OF ARTICLE I OF THE STATE CONSTITUTION OF 1963. 03580'99 Final page.
