A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 135 (MCL 750.135). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 135. (1)Exposing child with intent to injure or2abandon--Any father or mother of a child under the age of 6 3 years, orany other person who shall expose suchANOTHER INDI- 4 VIDUAL, WHO EXPOSES THE child in any street, field, house or 5 other place, with intent to injure or wholly to abandon it, 6shall beIS guilty of A felony, punishable by imprisonmentin7the state prisonFOR not more than 10 years. 8 (2) AN INDIVIDUAL SHALL NOT BE PROSECUTED UNDER SUBSECTION 9 (1) FOR ABANDONING A NEWBORN WHO IS NOT MORE THAN 72 HOURS OLD IF 10 THE NEWBORN IS LEFT INSIDE THE PREMISES OF A HOSPITAL IN SUCH A 11 MANNER THAT AN EMPLOYEE OF THE HOSPITAL IS AWARE BOTH OF THE 05930'00 * KDD 2 1 NEWBORN AND OF THE FACT THAT THE INTENT IS WHOLLY TO ABANDON THE 2 NEWBORN. AS USED IN THIS SECTION, "HOSPITAL" MEANS A HOSPITAL 3 THAT IS LICENSED UNDER PART 215 OF THE PUBLIC HEALTH CODE, 1978 4 PA 368, MCL 333.21501 TO 333.21568. 5 Enacting section 1.
