A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 40114 (MCL 324.40114), as added by 1995 PA 57. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 40114. (1) The department may issue a permit to a 2 person who is unable to walk due to being a paraplegic or an 3 amputee, or being permanently disabled and unable to walk because 4 of other disease or injury AUTHORIZING A PERSON TO TAKE GAME 5 WHILE IN OR UPON A STANDING VEHICLE IF THE PERSON, BECAUSE OF 6 DISEASE, INJURY, CONGENITAL CONDITION, OR AGE, IS OTHERWISE NOT 7 REASONABLY ABLE TO ENGAGE IN THE PHYSICAL ACTIVITIES NORMALLY 8 ASSOCIATED WITH THE TAKING OF GAME. A permit issued under this 9 subsection authorizes the person to take game during the open 10 season for that game, including deer of either sex, from or upon 05848'00 * TMV 2 1 a standing vehicle if that person holds a license to take that 2 game issued pursuant to UNDER part 435 and complies with all 3 other laws and rules for the taking of game. 4 (2) The department may issue a permit to a person who is 5 permanently disabled and who has full use of only 1 arm and who 6 upon investigation is unable to hold, aim, and shoot a bow. A 7 permit issued under this subsection authorizes the person to take 8 game during the open season for that game with a bow that has 9 been modified so that the bow may be held, aimed, and shot with 1 10 arm, if that person holds a license to take that game issued 11 pursuant to UNDER part 435 and complies with all other laws and 12 rules for the taking of game. 13 (3) In addition, the department may issue permits authoriz- 14 ing 1 or more of the following: 15 (a) The taking or possession of animals for the purpose of 16 rehabilitating animals. 17 (b) The taking of animals to prevent or control damage and 18 nuisance caused by the animals. 19 (c) The collection, transportation, possession, or disposi- 20 tion of animals and parts of animals for scientific purposes. 21 (d) The public exhibition of animals. 22 (e) Taxidermy. 23 (f) The disposition of accidentally or unlawfully taken or 24 injured animals or animals that are unlawfully possessed. 25 (g) The taking of game with a crossbow by a person who is 26 permanently disabled as provided in section 40115. 05848'00 * 3 1 (4) A permit issued under this section or section 40115 may 2 be suspended, revoked, annulled, withdrawn, recalled, canceled, 3 or amended pursuant to the administrative procedures act of 1969, 4 Act No. 306 of the Public Acts of 1969, being sections 24.201 to 5 24.328 of the Michigan Compiled Laws 1969 PA 306, MCL 24.201 TO 6 24.328. If the holder of a permit is convicted of violating this 7 section, his or her permit or license may be revoked and any 8 animal and the parts of any animal in his or her possession shall 9 be disposed of in a manner approved by the department. 10 (5) Except as otherwise provided in section 40115 for a 11 permit described in subsection (3)(g), all ALL fees received for 12 permits and licenses issued under this section shall be forwarded 13 by the department to the state treasurer to be credited to the 14 game and fish protection fund created in part 435 SECTION 15 43553. 05848'00 * Final page.
