A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 227f (MCL 750.227f), as amended by 1996 PA 163. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 227f. (1) Except as provided in subsection (2), an 2 individual who commits or attempts to commit a crime that 3 involves a violent act or a threat of a violent act against 4 another person while wearing body armor is guilty of a felony, 5 punishable by imprisonment for not more than 4 years, or a fine 6 of not more than $2,000.00, or both. A TERM OF IMPRISONMENT 7 IMPOSED FOR VIOLATING THIS SECTION SHALL BE SERVED CONSECUTIVELY 8 TO ANY TERM OF IMPRISONMENT IMPOSED FOR THE CRIME COMMITTED OR 9 ATTEMPTED. 05176'99 TVD 2 1 (2) Subsection (1) does not apply to either of the 2 following: 3 (a) A peace officer of this state or another state, or of a 4 local unit of government of this state or another state, or of 5 the United States, performing his or her duties as a peace offi- 6 cer while on or off a scheduled work shift as a peace officer. 7 (b) A security officer performing his or her duties as a 8 security officer while on a scheduled work shift as a security 9 officer. 10 (3) As used in this section: 11 (a) "Body armor" means clothing or a device designed or 12 intended to protect an individual's body or a portion of an 13 individual's body from injury caused by a firearm. 14 (b) "Security officer" means an individual lawfully employed 15 to physically protect another individual or to physically protect 16 the property of another person. 05176'99 Final page.
