HOUSE BILL No. 5187


     December 9, 1999, Introduced by Reps. Jamnick, DeRossett, Howell and O'Neil and
referred to the Committee on Criminal Law and Corrections.


        A bill to amend 1979 PA 53, entitled

   "An act to prohibit access to computers, computer systems, and
   computer networks for certain fraudulent purposes; to prohibit
   intentional and unauthorized access, alteration, damage, and
   destruction of computers, computer systems, computer networks,
   computer software programs, and data; and to prescribe
   penalties,"

   (MCL 752.791 to 752.797) by adding section 8.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         SEC. 8.  (1) A VIOLATION OR ATTEMPTED VIOLATION OF THIS ACT

 2    OCCURS IF THE PERSON KNOWS OR HAS REASON TO KNOW THAT THE ACCESS

 3    WILL RESULT IN THE COMMISSION OF A CRIME, IN WHOLE OR IN PART, IN

 4    THIS STATE.

 5         (2) A VIOLATION OF THIS ACT MAY BE PROSECUTED IN ANY JURIS-

 6    DICTION IN WHICH THE ACCESS ORIGINATED OR TERMINATED OR IN WHICH

 7    THE UNDERLYING CRIME WAS COMMITTED.

 1         Enacting section 1.  This amendatory act does not take

 2    effect unless all of the following bills of the 90th Legislature

 3    are enacted into law:
