HOUSE BILL No. 5185


     December 9, 1999, Introduced by Reps. O'Neil, DeRossett, Howell and Jamnick and
referred to the Committee on Criminal Law and Corrections.


        A bill to amend 1979 PA 53, entitled

   "An act to prohibit access to computers, computer systems, and
   computer networks for certain fraudulent purposes; to prohibit
   intentional and unauthorized access, alteration, damage, and
   destruction of computers, computer systems, computer networks,
   computer software programs, and data; and to prescribe
   penalties,"

   by amending section 6 (MCL 752.796), as amended by 1996 PA 326.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 6.  (1) A person shall not  utilize  USE
             a computer

 2    program, computer, computer system, or computer network to commit

 3    OR ATTEMPT TO COMMIT a crime.

 4         (2) THIS SECTION DOES NOT PROHIBIT A PERSON FROM BEING

 5    CHARGED WITH, CONVICTED OF, OR PUNISHED FOR ANY OTHER VIOLATION

 6    OF LAW COMMITTED BY THAT PERSON WHILE VIOLATING OR ATTEMPTING TO

 7    VIOLATE THIS SECTION, INCLUDING THE UNDERLYING OFFENSE.

 1         (3) THIS SECTION APPLIES REGARDLESS OF WHETHER THE PERSON IS

 2    CONVICTED OF COMMITTING OR ATTEMPTING TO COMMIT THE UNDERLYING

 3    OFFENSE.

 4         Enacting section 1.  This amendatory act does not take

 5    effect unless all of the following bills of the 90th Legislature

 6    are enacted into law:

 7         (a) Senate Bill No. _____ or House Bill No. 5184  (request
