A bill to amend 1974 PA 258, entitled "Mental health code," by amending section 208 (MCL 330.1208), as amended by 1995 PA 290. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 208. (1) Services provided by a community mental 2 health services program shall be directed to individuals who have 3 a serious mental illness, serious emotional disturbance, or 4 developmental disability. 5 (2) Services may be directed to individuals who have other 6 mental disorders that meet criteria specified in the most recent 7 diagnostic and statistical manual of mental health disorders pub- 8 lished by the American psychiatric association and may also be 9 directed to the prevention of mental disability and the promotion 10 of mental health. Resources that have been specifically 00564'99 * DAM 2 1 designated PROVIDED to community mental health services 2 programs for services to individuals with dementia, alcoholism, 3 or substance abuse or for the prevention of mental disability and 4 the promotion of mental health shall be utilized for those spe- 5 cific purposes. 6 (3) Priority shall be given to the provision of PROVIDING 7 services to individuals ALL OF THE FOLLOWING: 8 (A) INDIVIDUALS with the most severe forms of serious mental 9 illness, serious emotional disturbance, and developmental 10 disability. Priority shall also be given to the provision of 11 services to individuals 12 (B) INDIVIDUALS with a serious mental illness, serious emo- 13 tional disturbance, or developmental disability in urgent or 14 emergency situations. 15 (C) INDIVIDUALS WHO HAVE BEEN ORDERED TO OBTAIN MENTAL 16 HEALTH SERVICES UNDER SECTION 84 OF CHAPTER VII OF THE CODE OF 17 CRIMINAL PROCEDURE, 1927 PA 175, MCL 767.84, DURING THE TERM OF 18 THE CONTRACT ENTERED INTO UNDER THAT SECTION, REGARDLESS OF 19 WHETHER CRIMINAL CHARGES REMAIN PENDING. 20 (4) An individual shall not be denied a service because an 21 individual who is financially liable is unable to pay for the 22 service. 23 Enacting section 1. This amendatory act does not take 24 effect unless Senate Bill No. ______ or House Bill No. 5046 25 (request no. 00563'99 *) of the 90th Legislature is enacted into 26 law. 00564'99 * Final page. DAM
