     April 22, 1999, Introduced by Reps. Garcia, Ehardt, Kukuk, Gosselin, Voorhees, Mans, Vander Roest and Kuipers and referred to the Committee on House Oversight and Operations.


        A bill to amend 1984 PA 431, entitled

   "The management and budget act,"

   by amending section 442 (MCL 18.1442), as added by 1991 PA 72.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 442.  (1)  Funds  SUBJECT TO SUBSECTION (2), FUNDS

 2    appropriated to an entity within the legislative branch of state

 3    government shall be expended or be transferred to another account

 4    only with the written approval of the authorized agent of the

 5    legislative entity.  When the authorized agent of the legislative

 6    entity notifies the department of its approval of an expenditure

 7    or transfer within the existing level of appropriations, the

 8    department shall immediately make the expenditure or transfer.

 9    The authorized legislative entity agents shall be designated by

10    the speaker of the house for house entities, the senate majority

 1    leader for senate entities, and the legislative council for

 2    library of Michigan and legislative council entities.

 3         (2) EACH LEGISLATOR MAY DESIGNATE THAT NOT MORE THAN 50% OF

 4    THE FUNDS REMAINING IN THE LEGISLATOR'S INDIVIDUAL LEGISLATIVE

 5    OFFICE ACCOUNT AT THE END OF A FISCAL YEAR BE DEPOSITED INTO THE

 6    COUNTERCYCLICAL BUDGET AND ECONOMIC STABILIZATION FUND CREATED IN

 7    SECTION 351.
