HOUSE BILL No. 4555 April 22, 1999, Introduced by Reps. Neumann, Switalski, Rivet, Woodward, Spade, Quarles, DeHart, Howell, Tabor, Hale, Pappageorge, Brewer, Cherry, Baird, Basham, Bogardus and Jacobs and referred to the Committee on Transportation. A bill to amend 1967 PA 291, entitled "An act to authorize state universities and colleges to enact parking, traffic and pedestrian ordinances and to provide for the enforcement of the ordinances; and to dispose of fines collected," by amending section 2a (MCL 390.892a), as amended by 1998 PA 441. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2a. If the violation of a particular provision of the 2 ordinance is designated a civil infractionpursuant toUNDER 3 section 1, the governing board may establish civil sanctions for 4 those civil infractions, but a civil fine shall not be more than 5 $25.00. If the governing board establishes civil sanctions for a 6 violation of a particular provision of the ordinance designated a 7 civil infraction that prohibits parking in a parking space 8 reserved for use by persons with disabilities substantially 01013'99 a TJS 2 1 corresponding to section 674(1)(s) of the Michigan vehicle code, 2 1949 PA 300, MCL 257.674, the governing board shall establish a 3 civil fine of not less than$50.00$150.00 or more than 4$100.00$200.00. A civil sanction in excess of that prescribed 5 in the Michigan vehicle code, 1949 PA 300, MCL 257.1 to 257.923, 6 is in conflict with that act and is void to the extent of the 7 conflict. The ordinance shall not impose a misdemeanor penalty 8 for an act or omissionwhichTHAT is a civil infraction under 9 the Michigan vehicle code, 1949 PA 300, MCL 257.1 to 257.923. 10 Except as provided in section 3, the violation of a provision 11 designated a civil infraction in the ordinance shall be processed 12 in the same manner as a civil infraction under the Michigan vehi- 13 cle code, 1949 PA 300, MCL 257.1 to 257.923. 01013'99 a Final page.
