A bill to prohibit the employment of certain individuals less than 21 years of age to engage in certain acts in adult entertainment establishments; and to impose penalties. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Adult entertainment establishment" means a facility 3 that exhibits or makes available to patrons of the facility a 4 sexually explicit performance. 5 (b) "Sexually explicit performance" means a live presenta- 6 tion that wholly or in part depicts nudity, sexual excitement, 7 erotic fondling, sexual intercourse, or sadomasochistic abuse. 8 Sec. 2. (1) Except as provided in subsection (2), the owner 9 or operator of an adult entertainment establishment shall not 10 employ an individual less than 21 years of age to engage in a 02984'99 DMS 2 1 sexually explicit performance at that adult entertainment 2 establishment. 3 (2) This act does not apply to employment described in 4 subsection (1) if, before the effective date of this act, the 5 individual less than 21 years of age is already employed to 6 engage in a sexually explicit performance at the adult entertain- 7 ment establishment. 8 Sec. 3. A person who violates this act is guilty of a mis- 9 demeanor punishable by imprisonment for not more than 90 days or 10 a fine of not more than $5,000.00, or both. 02984'99 Final page. DMS
