BUILDERS: LICENSURE EXEMPTION - S.B. 149: COMMITTEE SUMMARY
Senate Bill 149 (as introduced 1-27-99)
Sponsor: Senator Ken Sikkema
Committee: Economic Development, International Trade and Regulatory Affairs
Date Completed: 11-9-99
CONTENT
The bill would amend the Occupational Code to exempt from the licensure requirements of Article 20 (Architects, Professional Engineers, and Land Surveyors) a person licensed under Article 24 (Residential Builders) who was engaged in planning, designing, or directing the construction of a single-family detached residential building of any size, only if the building permit were issued in the name of that licensee.
Currently, a person is subject to the penalties set forth in the Code if he or she submits to a public official of the State or a political subdivision of the State for approval a permit or plan for filing as a public record, a specification, a report, or a land survey that does not bear at least one seal of a licensee as required under Article 20. The Code exempts from this provision, a public work costing under $15,000 or a residential building containing up to 3,500 feet of calculated floor area. The bill also would exempt a single-family detached residential building of any size only if the building permit were issued to a person licensed under Article 24.
