A SUMMARY OF HOUSE BILL 5911 AS INTRODUCED 6-20-00


House Bill 5911 would amend the Uniform Condemnation Procedures Act to restrict the purposes for which eminent domain can be exercised. The act provides standards for acquisition of property, the conduct of condemnation, and the determination of just compensation. The bill would retain these provisions but would specify that the power of eminent domain could not be exercised for the purpose of acquiring real or personal property for a casino or casino enterprise, as defined in section 2 of the Michigan Gaming Control and Revenue Act. [Under that law, "casino" is defined to mean a building in which gaming is conducted. "Casino enterprise" is defined to mean the buildings, facilities, or rooms functionally or physically connected to a casino, including but not limited to any bar, restaurant, hotel, cocktail lounge, retail establishment, or arena or any other facility located in a city under the control of a casino licensee or affiliated company.]
