A SUMMARY OF HOUSE BILL 5863 AS INTRODUCED 5-30-00


House Bill 5863 would amend the Michigan Vehicle Code to prohibit access to driver record lists by insurers for certain purposes.


Currently the secretary of state is required to disclose personal information that is contained in driving records for thirteen purposes that are specified in law. Among those purposes is "for use by an insurer or insurance support organization, or by a self-insured entity, or its agents, employees, or contractors, in connection with a) claims investigating activity, b) antifraud activity, c) rating, or d) underwriting. House Bill 5863 would retain this provision but eliminate references to claims investigating activity, and also to underwriting. Under the bill, insurers would only have access to personal information in connection with antifraud activity or rating.
