A SUMMARY OF HOUSE BILL 5400 AS INTRODUCED 2-22-00
House Bill 5400 would amend the Michigan Vehicle Code to regulate the sale of personal information sold by the secretary of state. Under the bill, an application for a certificate of title would be required to contain a statement with an opportunity to inform the secretary of state that the owner desires to prohibit the disclosure of personal information maintained by the secretary of state pertaining to him or her for surveys, marketing, and solicitations.
Further, under current law, the secretary of state is required to furnish individuals with a conspicuous opportunity to be informed of their right to prohibit the disclosure of personal information, through printed signs in branch offices, paper forms, periodic press releases, public service announcements, advertisements, pamphlets, notices in electronic media, and other types of notice. (This is customarily called the opt out policy.) House Bill 5400 would require that a notice also be included with application and renewal forms for the registration of a vehicle. Finally, the bill would eliminate the provision in the law that requires the information printed on the form be similar to the information printed on branch office signs.
