A SUMMARY OF HOUSE BILL 4648 AS INTRODUCED 5-6-99
The bill would amend the Michigan Vehicle Code to increase the amount of time for which a court would be required to order the immobilization of a drunk driver's vehicle for a third or subsequent violation of certain drunk driving crimes. Currently, a court is required to order the immobilization of the defendant's vehicle for no less than six months and no more than three years. Under the bill, a court would be required to order that a drunk driver's vehicle be immobilized for no less than one year and no more than three years.
Under the current law and the law as it would be amended by the bill, a court would be required order the immobilization of a defendant's vehicle for a third or subsequent violation of any combination of the following crimes:
-- Operating a vehicle while under the influence of intoxicating liquor, a controlled substance, or a combination thereof; or with bodily alcohol content of 0.10 grams or more (first or second offense within seven years).
-- Operating a vehicle while visibly impaired.
-- Causing the death of another person while operating a vehicle while visibly impaired, under the influence or with a bodily alcohol content of 0.10 grams or more.
-- Causing the serious impairment of another person's body function while operating a vehicle while visibly impaired, under the influence or with a bodily alcohol content of 0.10 grams or more.
