A SUMMARY OF HOUSE BILL 4391 AS INTRODUCED 3-9-99


House Bill 4391 would amend the State School Aid Act to require that the foundation allowance for a transferring student follow that student to the new school district.


Under the bill, at the end a school year, a school district to which a pupil transfers (sometimes called a receiving district) would be required to report the transfer to the Department of Education, and also to the district in which the student was originally counted in membership (sometimes called the sending district). Upon receipt of the report, the sending district would be required to pay to the receiving district, an amount equal to the student's prorated foundation allowance, calculated according to the number of days during the school year the student was educated by and enrolled in both the receiving and sending districts.


Under House Bill 4391, if a sending district did not make the payment within 30 days after receiving the report, the Department of Education would be required to calculate the amount owed, deduct that amount from the sending district's first state school payment the next fiscal year, and pay that amount to the district to which the student transferred.


House Bill 4391 also would require the sending and receiving school districts to provide to the Department of Education all information the department would require to enforce this section.
