A SUMMARY OF HOUSE BILL 4349 AS INTRODUCED 2-15-99


Currently, the statute of limitations for product liability claims generally is three years. The bill would add a new section to the Revised Judicature Act that would set July 13, 1995, as the date on which the statute of limitations would begin for product liability lawsuits against manufacturers of blood products, where the lawsuit was based on the infusion of a blood product that resulted in HIV infection or AIDS. The bill would apply to all pending claims, including lawsuits filed before the bill's effective date that had not been dismissed or finally adjudicated.
