A bill to prescribe a tax on the sale and use of certain types of fuel in motor vehicles on the public roads or highways of this state and on certain other types of gas; to prescribe the manner and the time of collection and payment of this tax and the duties of officials and others pertaining to the payment and collection of this tax; to provide for the licensing of persons involved in the sale, use, or transportation of motor fuel and the collection and payment of the tax imposed by this act; to prescribe fees; to prescribe certain other powers and duties of certain state agencies and other persons; to provide for exemptions and refunds and for the disposition of the proceeds of this tax; to provide for appropriations from the proceeds of this tax; to prescribe remedies and penalties for the violation of this act; and to repeal acts and parts of acts.

"(H) A PERSON GRANTED GENERAL ADMINISTRATIVE CONTROL OF THE PUBLIC SCHOOL ACADEMY BY THE BOARD OF DIRECTORS OF A PUBLIC SCHOOL ACADEMY ESTABLISHED UNDER PART 6A OF THE REVISED SCHOOL CODE, 1976 PA 451, MCL 380.501 TO 380.507, OR OTHER PERSON DESIGNATED BY THE BOARD OF DIRECTORS OF THE PUBLIC SCHOOL ACADEMY.".
2. Amend page 8, following line 6, by inserting:
"(H) THE BOARD OF DIRECTORS OF A PUBLIC SCHOOL ACADEMY ESTABLISHED UNDER PART 6A OF THE REVISED SCHOOL CODE, 1976 PA 451, MCL 380.501 TO 380.507." and relettering the remaining subdivision.

House Resolution No. 448.
A resolution of tribute for the Honorable Laura Baird.
Whereas, The members of the House of Representatives extend our thanks and best wishes to Representative Laura Baird as she completes her tenure with this legislative body. Representative Baird was elected in 1994, and has represented the citizens of East Lansing, Okemos, and part of Haslett. Her efforts on the Health Policy Committee and her role as Minority Vice-Chair of both the Family and Civil Law Committee and Criminal Law and Corrections Committee have helped shape legislation in these vital areas; and
Whereas, Representative Baird, a native of Northern Michigan, earned a bachelor's degree from Western Michigan University. She went on to receive her law degree, with distinction, from Thomas Cooley Law School. Her public service record includes her leadership roles as an Ingham County Commissioner and Clinton-Eaton-Ingham Community Mental Health Board member. She also served as the Chair of the Economic Development Committee of the Michigan Association of Counties; and
Whereas, The wealth of experience that Representative Baird brought to Lansing includes teaching in Venezuela for a brief time and practicing law as an attorney. She has been a community advocate and has worked to improve local schools. Ms. Baird also served on the board of directors of the United Cerebral Palsy Association of Michigan. Her efforts have earned her laurels and accolades from a number of community and professional associations. Laura Baird has been a dedicated public servant in this legislative body while remaining committed to civic and community issues; now, therefore, be it
Resolved by the House of Representatives, That we honor Representative Laura Baird as she concludes her service with the Michigan House of Representatives; and be it further

A resolution of tribute for the Honorable Liz Brater.
Whereas, On the occasion of Representative Liz Brater's departure from the House of Representatives after a successful tenure, it is a privilege to congratulate her. Representative Brater has been a forceful advocate for mental health and environmental issues. Her knowledge has been a resource for her colleagues as they considered legislation affecting these areas of intense interest to Michiganians; and
Whereas, Inspired to enter politics fourteen years ago, Liz Brater first won a seat on the Ann Arbor City Council in 1988. In 1991, she vaulted to the office of mayor, and in 1994, won election to the state House of Representatives. Most recently, she served as Minority Vice-Chair of the Agriculture and Resource Management Committee and member of the Conservation and Outdoor Recreation Committee. In recognition of her work on the environment, the Sierra Club in 1996 named Representative Brater Environmentalist of the Year. During her time in public service, Ms. Brater has contributed to numerous committees and task forces on a variety of issues; and
Whereas, In addition to representing southern Ann Arbor and Pittsfield Township, Representative Brater has been involved in her community. Her bachelor's degree in American civilization and master's degree in American history gave her a broad perspective of her role as a citizen as well as a legislator. She has served a number of local and national civic and political organizations and has been an active educator and writer. Truly, Representative Brater has been a citizen-legislator who has served her constituents with dedication; now, therefore, be it

House Resolution No. 450.
A resolution of tribute for the Honorable Lingg Brewer.
Whereas, It is a privilege to extend the congratulations of this legislative body to Representative Lingg Brewer as he completes his service in the House of Representatives. His election in 1994 gave him the opportunity to represent the citizens of the region in which he was born, raised, and educated. He graduated from Eastern High School, attended Lansing Community College, and earned his bachelor's degree from Michigan State University. Lingg Brewer completed graduate work at California State University; and
Whereas, Government and its role has been a long-standing interest of Representative Brewer. He taught political science at Lansing Community College and worked on the campaign staff of Congressman Bob Carr. Mr. Brewer also served as an Ingham County Commissioner and Ingham County Clerk. He is a founder of the Impression Five Science Center and has contributed to a variety of civic and charitable organizations. Representative Brewer has been involved in issues of casino oversight as the Minority Vice Chair of the Gaming and Casino Oversight Committee. He has also worked on transportation issues and is a member of the House Oversight and Operations Committee. His experience and dedication to his constituents will be missed; and
Whereas, Lingg Brewer will have ample opportunities to continue serving his community and Michigan based on a life-long commitment to exercising the duties of citizenship. He will undoubtedly continue to dazzle his friends and neighbors with another antique car restoration project; now, therefore, be it

A resolution of tribute for the Honorable William Byl.
Whereas, On the occasion of the conclusion of his tenure of service in the Michigan House of Representatives, it is a privilege to recognize Representative William Byl. First elected in 1994, Mr. Byl has represented the 75th District with a commitment to public service that is admired by his colleagues. He earned their trust and served as Assistant Majority Floor Leader for much of his legislative career. During the Ninetieth Legislature, Representative Byl chaired the DNR/DEQ subcommittee of the Appropriations Committee. He has also co-chaired the Bi-Partisan Urban Caucus; and
Whereas, William Byl earned a bachelor's degree in mathematics and engineering from Calvin College. He worked for a consulting engineering firm until becoming a licensed professional surveyor in 1976. He is the president of a surveying and mapmaking company in Grand Rapids; and
Whereas, Already involved in a number of civic, religious, and professional organizations, William Byl entered government service as a Kent County Commissioner in 1987. His wide-ranging experience was invaluable in the House of Representatives. His interests ranged from conservation and the environment to recreation and transportation. Urban, education, and labor policies were also subjects of his work in the legislature. This citizen-legislator has made many contributions to Michigan and we are pleased to recognize his service to the state; now, therefore, be it
Resolved by the House of Representatives, That we honor Representative William Byl as he concludes his service with the Michigan House of Representatives; and be it further

A resolution of tribute for the Honorable Deborah Cherry.
Whereas, It is with respect for her accomplishments in this legislative body that the members of the House of Representatives pay tribute to Deborah Cherry. Representative Cherry has been an asset to the legislature, her district, and our state. She has served as Assistant Majority Floor Leader for her party and has been diligent in carrying out her responsibilities; and
Whereas, Deborah Cherry is a graduate of Oakland University and the University of Michigan at Flint where she earned her master's degree in public administration. Her road to Lansing included her extensive involvement in the political arena assisting others. Ms. Cherry accumulated a wealth of experience which she brought to the House of Representatives when she was elected in 1994. Her background includes work in the legislature and a variety of jobs that assisted senior citizens, such as her service as an analyst for the Michigan Office of Services to the Aging. She was elected to the Genesee County Commission in 1988 and served as the commission's chairperson from 1991 to 1993; and
Whereas, Representative Cherry authored public acts on labor, domestic violence, and taxation issues during her tenure in the House of Representatives. She also worked extensively on education and campaign finance reform. Service to her community has been a high priority for Ms. Cherry as well, and she has been involved in numerous civic, educational, policy, and political organizations. As she looks to the future, we are confident that Representative Cherry's zeal for public service will continue to be evident in her accomplishments; now, therefore, be it
Resolved by the House of Representatives, That we honor Representative Deborah Cherry as she concludes her service with the Michigan House of Representatives; and be it further

A resolution of tribute for the Honorable Eileen DeHart.
Whereas, It is a great pleasure for her colleagues and staff to join in expressing our respect to Representative Eileen DeHart as she completes her tenure of service to her community and our state as a member of the House. We sincerely appreciate her dedication, energy, and insights over the past six years. Her willingness to speak out on issues has earned her the admiration of people on both sides of the political aisle; and
Whereas, A civic activist for many years in the Westland area, Eileen DeHart has contributed to the work of a wide array of organizations over the years. These have ranged from extensive involvement with youth and school groups to responsibilities on commissions in Westland, including those related to planning and housing for the elderly. The strong bonds she had within the community were strengthened in her work as a key staff person for Representative Justine Barns; and
Whereas, In 1994, Eileen DeHart was elected to the first of her three terms as a lawmaker. Since that time, Representative DeHart has been most effective in speaking for her district on a host of issues. Her commitment to the legislative process has also been demonstrated in her committee work. Representative DeHart has distinguished herself as a vice chair of the Senior Health, Security and Retirement Committee and through her efforts with the House Oversight Committee, the Joint Committee on Administrative Rules, and the Legislative Retirement Board of Trustees. She has also served as the Assistant Associate Speaker Pro Tempore; now, therefore, be it
Resolved by the House of Representatives, That we commend Representative DeHart in acknowledgment of her devotion as a member of this legislative body over the past six years; and be it further

A resolution of tribute for the Honorable Terry Geiger.
Whereas, It is with great appreciation for his commitment to our state and its future that we honor and thank Representative Terry Geiger as he completes his tenure of service to the Michigan House of Representatives. His sense of responsibility as a lawmaker has been a continuation of the dedication to civic involvement that has marked all aspects of his life. We commend him at this milestone with the knowledge that our state has been strengthened through his efforts; and
Whereas, A graduate of Alma College, Terry Geiger has taken on leadership roles in business, local government, education, and community organizations within Barry County. He has served with distinction as a Woodland Township trustee, as a member of numerous school improvement teams, as a small businessman, as a member of the Lakewood Wastewater Authority, and as a member of a host of respected business groups. This diverse background, coupled with his sense of public duty, led to his election to the Michigan House of Representatives in 1994; and
Whereas, Over the course of his three terms in the House, Representative Geiger has put to good use his experience and knowledge in a variety of issue areas. Highlights of his six years include serving as chair of the Judiciary Subcommittee of the House Appropriations Committee, working for the reform of court funding in Michigan, and promoting performance measures in state spending. In his third term, Representative Geiger served as the chair of the House Appropriations Committee, where his personal integrity has been invaluable in the challenging task of managing the state's financial resources. In all, this dedicated gentleman has earned the admiration of his fellow lawmakers and the people of Michigan; now, therefore, be it
Resolved by the House of Representatives, That we offer this expression of respect and gratitude to Representative Terry Geiger as he brings to a close his service to this legislative body; and be it further

A resolution of tribute for the Honorable Mike Green.
Whereas, It is a great pleasure for us to extend best wishes and thanks to Representative Mike Green as his service to the Michigan House of Representatives draws to a close with the conclusion of the Ninetieth Legislature. His tenure of service has been marked by a strong sense of commitment and sensitivity to a wide range of issues important to Michigan's future; and
Whereas, Mike Green came to his legislative responsibilities following his 1994 election with a diverse range of experiences and accomplishments. His efforts in farming for twenty years, as a tool and die maker for twenty-eight years, and as a member of a host of local and state commissions prepared him well for the hard work of shaping our state's laws and programs. Representative Green distinguished himself in eight years on the Tuscola County Commission, four years on the State Commission on Aging, several years with local and regional agencies on aging, and leadership in a number of agricultural organizations. This background has proven invaluable to the people of Representative Green's district and his colleagues in the House; and
Whereas, Highlights of Representative Green's three terms include his work as the chair of the Agriculture and Resource Management Committee and leadership in efforts to revamp Michigan's laws related to concealed weapons and hunting. In addressing these matters, he has demonstrated a personal sense of conviction and standards of public service that have earned him respect from people in all corners of our state; now, therefore, be it

A resolution of tribute for the Honorable Michael J. Hanley.
Whereas, As the Ninetieth Michigan Legislature draws to a close, it is most appropriate to honor and thank Representative Michael Hanley for his commitment to the legislative process and to our state. Over the course of his three terms of service to this body, he has earned our respect for his dedication and energy in all aspects of his responsibilities, including his leadership of the Democratic Caucus for the past two years; and
Whereas, A native of Saginaw, Michael Hanley is a graduate of Western Michigan University who has devoted himself to a wide range of activities and community groups. His diverse background includes working seventeen years in the Saginaw Division of General Motors and extensive involvement in organized labor. Working with management and employees to solve problems, he developed communications skills that benefited his hometown in many ways. He distinguished himself as a member of the Saginaw City Council beginning in 1987, including his service as the Mayor Pro Tem, prior to his election to the House of Representatives in 1994; and
Whereas, As a lawmaker, Representative Hanley's quick grasp of issues has proven invaluable in policy discussions and in his committee responsibilities. His leadership skills are reflected not only in his selection as the Democratic Leader but also by his work in helping to organize the House Bipartisan Urban Caucus and his contributions to the transition to the new realities of the legislature operating in a term limited environment. His commitment has earned our thanks; now, therefore, be it

Whereas, As the Ninetieth Legislature draws to a close, it is most appropriate to express our appreciation to Representative Jellema for his leadership and dedication as a lawmaker. His three terms of service have been marked by the effectiveness, unselfishness, and commitment that have characterized every component of his life; and
Whereas, Jon Jellema came to Lansing following his 1994 election to the Michigan House of Representatives with a long and impressive record of service in our state. A graduate of Calvin College with a master's degree from Michigan State University, he has devoted much of his professional life to the education of our citizens. In addition to his faculty responsibilities with Grand Valley State University over the years, he has also been an activist within his community of Grand Haven as a member of the Grand Haven Board of Education. Mr. Jellema has also worked at the state level through the Michigan Association of School Boards; and
Whereas, Representative Jellema has incorporated his experiences and insights on administrative matters and public policy into his responsibilities as a legislator. He has contributed a great deal to the appropriations process as a majority vice chair of the House Appropriations Committee and as the chair of the Joint Capital Outlay Committee. In these posts, he has played a key role in how our state invests in its people and institutions. Clearly, the impact of Representative Jellema's hard work will long benefit Michigan; now, therefore, be it

Whereas, Representative Kelly earned a bachelor's degree in history and education from Fordham University and a master's degree in library science from Long Island University, and proudly served his country in the United States Air Force. A retired library director for Wayne-Westland Community School District and a former assistant professor at Henry Ford Community College, Mr. Kelly served on the Wayne City Council for twelve years and, since 1995, has been a Trustee of the Library of Michigan; and
Whereas, As a member of the Appropriations Committee and Minority Vice Chair of the K-12/Education Subcommittee, Representative Kelly has been a stalwart supporter of public education and funding for public libraries. During his legislative career, he has advanced the interests of the commonweal through his steadfast dedication to public service; and
Whereas, A graduate of the Bronson Hospital School of Nursing in 1977 and a self-employed plumber from 1985 to 1992, Representative LaForge also served as a Kalamazoo city commissioner from 1981 to 1991. These wide-ranging responsibilities and experiences prepared him well for the diverse issues discussed at the Capitol; and
Whereas, Since his election in 1994, Representative LaForge has been a strong advocate of child development issues. In 1997, as chair of the Human Services and Children Committee, he worked in tandem with Lieutenant Governor Connie Binsfeld's Commission to reform Michigan's adoption, foster care, and child protection laws. Further, in 1999, the Michigan Council for Maternal and Child Health named him "Legislator of the Year." Whereas, Representative Law earned bachelor's and master's degrees in business administration from the University of Detroit. He also received a law degree from Wayne State University. In addition to working as a commercial credit analyst for the Bank of the Commonwealth, he was employed as a financial analyst for Ford Motor Company and contributed to an array of civic groups in Wayne County; and
Whereas, This former Plymouth Township Supervisor served in the House of Representatives from 1983 to 1991 and again from 1995 to the present. Representative Law has distinguished himself as the chair of the Health Policy Committee, as well as a member of the Family and Children Services, Family and Civil Law, Gaming and Casino Oversight, and Insurance and Financial Services Committees. Moreover, she is committed to such community and civic groups as the Capitol Area Health Alliance, the Coalition for Community Concerns, the Youth in Government Board, the Downtown Neighborhood Association, and the East Side Neighborhood Organization; and

Her twenty-five-year career as a registered nurse included serving as head nurse for a psychiatric unit in Petoskey, and in 1986 the governor appointed her to membership on the Michigan Health Occupations Council. In addition, she brought experience in local government as a former member of the Macomb County Board of Commissioners to her role as a legislator; and
Whereas, Representative Rocca has been especially active in legislative proposals to cut taxes, cut crime, provide quality health care, and assist the elderly. Through her work on the Constitutional Law and Ethics Committee, Health Policy Committee, and Senior Health and Security Committee and through her services as chair of the Regulatory Reform Committee, she has distinguished herself as an effective lawmaker. In 1988, she was elected the first woman mayor of Highland Park. In addition, she has devoted herself to service in a variety of community organizations, including her active membership in the Russell Street Missionary Baptist Church.
Whereas, Throughout her six-year tenure with the House, Representative Scott has been especially active working on behalf of Michigan's children and families. A graduate of Fisk University in Nashville, Tennessee, Ed Vaughn has distinguished himself in a wide array of responsibilities, including as a member of the United States Military from 1957-1959, as a proud owner of Vaughn's Book Store in Detroit, as a teacher of African-American history in numerous Detroit area colleges, and as Executive Assistant to Detroit Mayor Coleman Young. The skills he developed in these fields have enhanced his effectiveness as a lawmaker in his term with the Eightieth Legislature (1979-80) and the last three terms (1995-2000); and
Whereas, Representative Vaughn has contributed to the work of committees dealing with economic development and regulatory reform and has shown effective leadership with his service as Minority Vice-Chair of the Constitutional Law and Ethics Committee. A bill to amend 1980 PA 300, entitled "The public school employees retirement act of 1979," by amending section 5 (MCL 38.1305), as amended by 2000 PA 150.
The Senate has appointed Senators Gougeon, McManus and DeBeaussaert as conferees to join with Reps. Vander Roest, Voorhees and DeHart.
The bill was referred to the Conference Committee on December 8, 2000.
