ENROLLED HOUSE BILL No. 5475

AN ACT to prohibit the expenditure of state funds for the purpose of human cloning.

The People of the State of Michigan enact:

Sec. 1. This act shall be known and may be cited as "the human cloning funding prohibition act".

Sec. 2. As used in this act, "human cloning" means that term as defined in section 16274 of the public health code, 1978 PA 368, MCL 333.16274.

Sec. 3. A person shall not use state funds to engage in or attempt to engage in human cloning.

Sec. 4. Section 3 does not prohibit the use of state funds for scientific research or cell-based therapies not specifically prohibited by that section.

Sec. 5. This act does not give a person a private right of action.

Sec. 6. A person who violates section 3 is subject to a civil fine of $10,000,000.00. A civil fine imposed under this section shall be distributed in the same manner in which penal fines are distributed in this state.

Enacting section 1. This act does not take effect unless all of the following bills of the 89th Legislature are enacted into law:

(a) House Bill No. 4846.

(b) House Bill No. 4962.

(c) Senate Bill No. 864.
