Eternal God, our Father, we thank You for this day. This is the day that You have made, and Your word instructs us to rejoice and to be glad in it, Lord. We thank You for these fine men and women who You have placed in leadership here in our state. We thank You, Lord, for giving them favor with the people of this great state. We thank You, Lord, for giving them sober and wise judgment on how to handle and to rule in this state. We ask You now, Lord, for Your presence and for Your anointing to be with them. We ask You to let Your angels encamp round about them, keeping them from all hurt, harm, and danger.

You said in Your word that if we would trust in You with all our hearts and lean not to our own understanding, but in all our ways acknowledge You, You declare that You would direct our path. We ask You now, Lord, to illuminate their path that they may see the clear and the perfect direction that You are leading them into. And finally, Lord, we ask You to be in the midst as they deliberate, as they rule in this great state. Help them, Lord, to remember not just some of the people of this state, but all of the people of this great land, and we'll forever give You the praise and the glory for it all belongs to You anyway. In the name of Jesus Christ we pray. Amen.

House Concurrent Resolution No.78.

A concurrent resolution to memorialize the Congress of the United States to increase the amount of money being distributed to the states from the Leaking Underground Storage Tank Trust Fund.

Whereas, In 1988, the EPA put into place regulations requiring all underground storage tank systems to meet stricter environmental protection standards. Tank systems installed before 1988 must be upgraded by December 22, 1998, or be removed; and

Whereas, Many tank owners and operators discovered leaks at their sites when they begin upgrading their tank systems. Consequently, Michigan and other states have seen a dramatic increase in the number of known leaking storage tank sites; and

Whereas, While progress has been made in Michigan and elsewhere on the job of cleaning up affected areas, the task remaining is very large. It presents a serious challenge to most of the states, including Michigan. The primary obstacle to the completion of this endeavor is the high costs facing tank owners and operators to clean up their leaking underground storage tank sites; and

Whereas, A key element in the massive task of dealing with leaking underground storage tanks is the trust fund created through the Superfund Revenue Act of 1986. Funded by a .1 cent per gallon tax on motor fuel, the LUST Trust Fund has a current balance of approximately $1.2 billion. While the .1 cent per gallon tax was discontinued for nearly two years, the tax was reinstituted, beginning on October 1, 1997. The fund will take in approximately $200 million annually; and

Whereas, In spite of the fund's size and in spite of the pressing need for money by the states in order to comply with the December 22, 1998, deadline for cleanup, the fund releases a far lower amount each year than it could distribute. It is estimated that only one-third of the available money has been distributed to the states; and

Whereas, Accelerating distributions from the trust fund would provide much needed help to the states in achieving the goal of correcting one of our country's most significant environmental problems; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we memorialize the Congress of the United States to increase the amount of money being distributed to the states from the Leaking Underground Storage Tank Trust Fund; and be it further

A concurrent resolution to urge the Department of Education to encourage gun safety education.

Whereas, The history of Michigan is rich with a long heritage of recreational shooting sports, including hunting and other rifle, shotgun, blackpowder, and handgun marksmanship activities. This heritage also includes the efforts of parents and outdoors organizations to promote the safe and responsible use of firearms equipment; and

Whereas, The most important component of education on gun safety is developing strategies to teach children how to act safely around firearms. This is a critical step in the effort to reduce the number of accidents related to firearms that involve children; and

Whereas, There are established child firearm safety programs available to meet this need. These educational initiatives offer clear lifesaving messages to children, such as leaving any area where a firearm is present and quickly notifying an adult. These respected programs include the Eddie Eagle Elementary Gun Safety Program. This nationally recognized firearm safety program has been taught to over 6,000,000 children since 1988. It has been recognized by the National Safety Council as the Outstanding Community Service Program for 1993; and

Whereas, Michigan would do well to encourage more firearm safety programs through our schools and communities; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we urge the Department of Education to encourage gun safety programs in our schools and communities; and be it further

Resolved, That a copy of this resolution be transmitted to the Department of Education.

House Concurrent Resolution No.85.

A concurrent resolution to urge the Lottery Bureau to halt actions to disqualify political bingos.

Whereas, The use of bingo games as a means of raising money for certain purposes is recognized as a grass-roots tool that brings people together for a worthy purpose. For many years, bingo fund raisers have helped political candidates or groups supporting a political idea. Political bingos represent a valuable alternative to fund raising efforts predicated on the size of a contribution rather than the number of people supporting an idea or person; and

Whereas, In 1994, using bingo as a way to raise money for political candidates or ideas was prohibited under the provisions of 1994 PA 118. Within a few weeks of the measure's enactment, an organization of citizens commenced a signature gathering campaign to invoke the referendum under Michigan's constitution. Following considerable effort and various challenges, the Secretary of State ruled in February 1995 that the signatures were insufficient in number to invoke the referendum. A law suit was filed to challenge the ruling of the Secretary of State. In the same month (February 1995), the Secretary of State also ruled that political bingo is subject to regulation under both the state's lottery and campaign finance acts; and

Whereas, Following negotiations, a legislative compromise was reached to permit licensing for political bingos under campaign finance statutes. This act, 1995 PA 264, includes a fifty-dollar limit and various reporting requirements. In another bill, and apart from the compromise, language from the original act to ban political bingo (1994 PA 118) was enacted as part of 1995 PA 275. The citizens fighting the ban on political bingos filed suit immediately; and

Whereas, In February 1996, the Michigan Court of Appeals ruled 3-0 that the signatures submitted to invoke the referendum were valid and that 1994 PA 118 should have been suspended until the people decided on the question with their votes. A motion for dismissal was filed by the group seeking to ban political bingos. The Court of Appeals denied the motion and made specific reference to 1995 PA 275, saying the final decision must go before the voters. The Court of Appeals disagreed with the argument that 1995 PA 275 nullified the validity of efforts to decide the question of political bingos in a referendum; and

Whereas, At the November 1996 election, Michigan's electorate voted, by a substantial 1,936,198 to 1,511,063 margin, that 1994 PA 118 should not go into effect and should not become law; and

Whereas, In spite of the voters' decision in November 1996, the Lottery Bureau is issuing letters to disqualify political bingos, citing 1995 PA 275; and

Whereas, The voters of Michigan have clearly expressed their wishes to permit political bingos; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we urge the Lottery Bureau to halt actions to disqualify political bingos; and be it further

Resolved, That copies of this resolution be transmitted to the Lottery Bureau.

Whereas, Grand Valley State University has estimated that the cost to complete the total project for the School of Business and Graduate Library has increased to $52,650,000; and

Whereas, Grand Valley State University has agreed to fund the increase in the project cost of $2,650,000, with the state commitment remaining at $37,525,000; and

Whereas, Pursuant to Section 246 of 1984 PA 431, being MCL § 18.1246, the authorized cost of projects shall only be established or revised by specific reference in a budget act, by concurrent resolution adopted by both houses of the legislature, or inferred by the total amount of any appropriations made to complete plans and construction; now, therefore, be it

Resolved by the Senate (the House of Representatives concurring), That the Michigan Legislature recognizes the need to increase the total authorized cost for the Grand Valley State University School of Business and Graduate Library to an amount not to exceed $52,650,000 (State Building Authority share $37,524,900; State General Fund/General Purpose share $100; and Grand Valley State University share $15,125,000) and that the Legislature intends to continue to appropriate funds for construction subject to the limitations herein stated, in amounts not to exceed the authorized cost, subject to the ordinary vicissitudes of the legislative process; and be it further

I would like to take a couple of moments this morning to announce to this chamber one of my longest serving staff members, Eileen McNulty, who's been with me for seven years; she is leaving in the next week or so. My loss, unfortunately, is fortunately U.S. Senator Spence Abraham's gain. She will be serving as his new west Michigan Director. Joining us and paying tribute to Eileen today is her family who is in the east Gallery. Her mother, Maria, her sister, Maureen, and her brother, Patrick, have come here to help recognize all the work that Eileen has done for us. She's really, in the seven years, worked tirelessly on behalf of the Senate and on behalf of myself, as the Director of External Affairs in my district. I am certainly going to miss her after this long period of time. She has attended countless meetings and has worked very closely with all members of the Senate staff and many of the members of our caucus. I know a number of you have gotten to know her real well. Today is a little bit of a sad day for me, and I just wanted to say, Eileen, we would like to present you with this tribute and wish you well as you leave it.

Senator Hart's statement is as follows:

For purposes of apprising the Senate body of a disaster resolution, a disaster declaration resolution that I will be releasing shortly. Last week, Mother Nature struck a quick and devastating blow in my district. Heavy rains led to severe flooding in the communities of Allen Park, Dearborn Heights, Inkster, Taylor, and Westland that desperately need financial support to recover from the disaster of last week's flood.

Wayne County and Dearborn Heights officials have already declared disaster areas. Last Thursday, I toured the area and saw the damage for myself. I talked with families who were forced out of their homes and into emergency shelters by the flood waters. These people need our help now.

I have requested a resolution asking the Governor to declare a disaster area in these communities. If the state declares a disaster, these people will be eligible for state and federal assistance.

This flood has been an unmitigated disaster. People and businesses are faced with expensive cleanup costs. The Dearborn Heights Number 7 School District was forced to close for most of last week. The district now faces substantial repair costs because of the water damage.

Severe weather can strike any community at any time. The only thing we can be sure of in these situations is our quick action to lend a helping hand with the cleanup and rebuilding. Today it is my communities that are affected. Tomorrow or next week or next summer it may be your communities that need our help. When my resolution is ready, I hope that we can act quickly on it so that the Governor can sign it and get much needed assistance to these people.
