Keep us, O God, from all pettiness. Let us be large in thought, in word and in deed. Let us be done with faultfinding and leave off all self-seeking. May we put away all pretense and meet each other face to face without self-pity and without prejudice. May we never be hasty in judgment and always be generous. Let us always take time for all things and make us to grow calm, serene and gentle. Teach us to put into action our better impulses, to be straightforward and unafraid. Grant that we may realize that it is the little things in life that create differences and in the big things in life we are as one. O Lord God, let us not forget to be kind. Amen.

A bill to amend 1995 PA 29, entitled "Uniform unclaimed property act," by amending sections 11, 18, 19, 20, 23, 25, and 31 (MCL 567.231, 567.238, 567.239, 567.240, 567.243, 567.245, and 567.251); and to repeal acts and parts of acts.

The Committee of the Whole reported back to the Senate, favorably and with a substitute therefor, the following bill:
Senate Bill No. 306, entitled
A bill to amend 1964 PA 170, entitled "An act to make uniform the liability of municipal corporations, political subdivisions, and the state, its agencies and departments, officers, employees, and volunteers thereof, and members of certain boards, councils, and task forces when engaged in the exercise or discharge of a governmental function, for injuries to property and persons; to define and limit this liability; to define and limit the liability of the state when engaged in a proprietary function; to authorize the purchase of liability insurance to protect against loss arising out of this liability; to provide for defending certain claims made against public officers and paying damages sought or awarded against them; to provide for the legal defense of public officers and employees; to provide for reimbursement of public officers and employees for certain legal expenses; and to repeal certain acts and parts of acts," by amending the title and sections 1, 2, 4, and 6 (MCL 691.1401, 691.1402, 691.1404, and 691.1406), the title and section 1 as amended by 1986 PA 175 and section 2 as amended by 1996 PA 150, and by adding sections 2a and 2b.
Substitute (S-1).
The following is the amendment to the substitute recommended by the Committee of the Whole:
1. Amend page 7, following line 27, by inserting:
"(10) THERE IS NO LIABILITY UNDER THIS SECTION FOR THE FAILURE TO INSTALL A GUARDRAIL IF THE FAILURE TO INSTALL A GUARDRAIL WAS IN CONFORMANCE WITH GENERALLY ACCEPTED ENGINEERING STANDARDS.
(11) THERE IS NO LIABILITY UNDER THIS SECTION IF THE GUARDRAIL THAT IS THE BASIS FOR THE ACTION HAS BEEN INSTALLED AND MAINTAINED, ALTERED, UPGRADED, OR IMPROVED IN CONFORMANCE WITH GENERALLY ACCEPTED ENGINEERING STANDARDS.
(12) SUBJECT TO THE LIMITATIONS OF SUBSECTIONS (10) AND (11), ANY ACTION UNDER THIS SECTION ALLEGING DAMAGES BASED ON A GUARDRAIL SHALL ONLY BE BROUGHT IF THE DEFENDANT'S ACT OR OMISSION WAS GROSS NEGLIGENCE. AS USED IN THIS SUBSECTION, "GROSS NEGLIGENCE" MEANS CONDUCT SO RECKLESS AS TO DEMONSTRATE A SUBSTANTIAL LACK OF CONCERN FOR WHETHER AN INJURY RESULTS.".

A resolution commending and congratulating the Ottawa Hills High School Boys Basketball Team and its coaching staff for their achievements and the realization of their goal for securing the State Class A Basketball Championship Title.
Whereas, The skill, dedication, and determination of each player and the motivation, knowledge, and experience of Coach Eaddy and his staff shall be recognized; and
Whereas, The families, students, fans, and school administration have given their support to cheer on their home team and help it to overcome obstacles and celebrate its victories; and
Whereas, The game of basketball has helped to instill character, perseverance, and hope within the game's athletes and coaches; and
Whereas, Coach James Eaddy has been committed to his players and to Ottawa Hills High School for the enhancement of each; now, therefore, be it
Resolved by the Senate, That tribute be accorded to salute the Ottawa Hills High School Boys Basketball Team, Class A State Champions, and its coaching staff on their outstanding season and championship victory; and be it further
Resolved, That a copy of this resolution be transmitted to Ottawa Hills High School, each team member, Coach James Eaddy and his coaching staff as evidence of our congratulations.

Senate Resolution No. 47.
A resolution commending Donald A. MacDonald.
Whereas, It is a distinct personal privilege to honor Don MacDonald for his tireless commitment to the people of the City of Detroit. In the 12 years in which he has been employed at Brightmoor Community Center, he has inspired people to be dedicated, tenacious, to pursue excellence, and above all, believe that they will make it. We extend to him our heartfelt gratitude and praise his outstanding contributions to bringing out the best in everyone he works with; and
Whereas, The people who take advantage of the services available at Brightmoor Community Center are fortunate to have Don's help, as he is both knowledgeable and experienced in social work and committed to imparting his knowledge and advice to those in need. Don is a graduate of Wayne State University, School of Social Work, and is presently the ACBSW, Vice President and Chair of Operator Officers. He is currently practicing social work in the areas of neighborhood development, community organization, technical assistance, research, grant writing and contract management; and
Whereas, For the past 10 years Don has managed the transportation service contract for seniors and handicappers here at the Brightmoor Community Center. Don was also involved with the exemplary program management of Home Support Services, a program for seniors 60 and over that helps them with homemaker and chore worker assistance in their homes. He expanded the service area and added a special "Heat's On - Water's Off" union partnership with the Plumbing and Heating Industry Association. In conjunction with this program, Don continues to coordinate 175 volunteers once a year to provide furnace and water inspections and repair on a Saturday in October; and
Whereas, Don has been married to his wife, Jayne, for the past 16 years, and they are blessed with one son, Brian. For years they have been members of the Thoroughbred Owners and Breeders Association of Michigan, and have enjoyed being owners of thoroughbred race horses, actively racing them at the Ladbroke Racetrack in Detroit; now, therefore, be it
Resolved by the Senate, That tribute be hereby accorded to Donald A. MacDonald, who has been so dedicated in serving the Great Lakes State; and be it further
Resolved, That a copy of this resolution be transmitted to Donald A. MacDonald as evidence of our respect and esteem.

House Concurrent Resolution No. 32.
A concurrent resolution to urge the Civil Service Commission to reject the proposed change to Civil Service rules that would exempt from review personal service contracts of less than $500,000.
Whereas, Under the current rules of the Civil Service Commission, personal service contracts for more than $5,000 must receive Civil Service review and approval; and
Whereas, The Civil Service Commission is considering several amendments to its rules, including changes to the rules on personal service contracts to allow state departments to self-approve personal service contracts under $500,000 or $2 million for the life of the contract, essentially exempting them from the requirement of Civil Service review unless the amount of the contract is $500,000. The proposed rule change also would require prior approval in certain other situations, including a contract being for $2 million or more over the life of the contract or if there are more than five contracts involving a single state agency in a fiscal year; and
Whereas, The Civil Service Commission is also considering a proposal that would eliminate personal service contracts from any Commission review if those services were in a "mixed" contract, including disbursements for nonservices; and
Whereas, Raising from $5,000 to $500,000 the threshold for Civil Service review is a major change to how state agencies can use personal service contracts. This represents a dramatic loss of accountability in the awarding of contracts involving millions of state tax dollars; and
Whereas, With the pending retirement of a substantial number of state employees, the proposed change to Civil Service rules has the potential for abuse through a drastic reduction in oversight. Instead of work being performed by men and women operating under the well-defined public review of a Civil Service system that has served our state well, work and money will be shifted to private contractors with far less accountability to the taxpaying public. This change has some observers concerned over patronage replacing key operations of state government; and
Whereas, Public trust in governmental operations is essential to the health of our democracy. Returning to policies that diminish accountability, especially before money is spent, erodes this trust; now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), That we urge the Civil Service Commission to reject the proposed change to Civil Service rules that would exempt from review personal service contracts of less than $500,000; and be it further
Resolved, That a copy of this resolution be transmitted to the Civil Service Commission.
The House of Representatives has adopted the concurrent resolution.
