A bill to amend 1893 PA 206, entitled "An act to provide for the assessment of rights and interests, including leasehold interests, in property and the levy and collection of taxes thereon, and for the collection of taxes levied; making such taxes a lien on the property taxed, establishing and continuing the lien, providing for the sale and conveyance of property delinquent for taxes, and for the inspection and disposition of lands bid off to the state and not redeemed or purchased; to provide for the establishment of a delinquent tax revolving fund and the borrowing of money by counties and the issuance of notes; to define and limit the jurisdiction of the courts in proceedings in connection therewith; to limit the time within which actions may be brought; to prescribe certain limitations with respect to rates of taxation; to prescribe certain powers and duties of certain officers, departments, agencies, and political subdivisions of this state; to provide for certain reimbursements of certain expenses incurred by units of local government; to provide penalties for the violation of this act; and to repeal certain acts and parts of acts in anywise contravening any of the provisions of this act," (MCL 211.1 to 211.157) by adding section 9g.

Senate Concurrent Resolution No. 100.

A concurrent resolution approving the conveyance of property to the State Building Authority and approving a lease between the State of Michigan and the State Building Authority relative to the Department of State Police Two-Way Radio System and Microwave Backbone System Phase II.

Whereas, Section 5 of 1964 PA 183, as amended, being MCL § 830.415, requires the approval of the State Administrative Board, the Attorney General, and the Michigan Legislature by concurrent resolution concurred in by a majority of the members elected to and serving in each house, with the votes and names of the members voting thereon entered in the Journal, before land owned by the State of Michigan (the "State") may be conveyed to the State Building Authority (the "Authority"); and

Whereas, The sites for Phase II of the Department of State Police Two-Way Radio System and Microwave Backbone System are located in Allegan, Barry, Berrien, Branch, Calhoun, Cass, Clare, Ionia, Isabella, Kalamazoo, Kent, Lake, Mason, Mecosta, Montcalm, Muskegon, Newaygo, Oakland, Oceana, Osceola, Ottawa, Saginaw, St. Joseph, and VanBuren Counties. The sites and related equipment (the "Facilities") are currently owned by the State; and

Whereas, Section 7 of 1964 PA 183, as amended, being MCL § 830.417, requires the approval of the State Administrative Board and the Michigan Legislature by concurrent resolution concurred in by a majority of the members elected to and serving in each house with the votes and names of the members voting thereon entered in the Journal, before the State may enter into a lease with the Authority on a showing of a public purpose; and

Whereas, Providing facilities and equipment to be used by the State pursuant to a lease for Facilities is a recognized public purpose; and

Whereas, A lease between the Authority and the State has been prepared providing for the leasing of the Facilities by the Authority to the State (the "Lease"); and

Whereas, The Executive Director of the Authority has, by communication dated November 5, 1998, which communication is available and filed with the Secretary of the Senate, furnished the Joint Capital Outlay Subcommittee of the Legislature with information and documents relative to the Lease; now, therefore, be it

Resolved by the Senate (the House of Representatives concurring), That the total cost of the Department of State Police Two-Way Radio System and Microwave Backbone System Phase II consisting of the Facilities shall not exceed $42,660,808, plus interest charges on monies advanced by the State to meet the construction cash flow requirements of the Facilities, if any, of which not more than $42,660,808, plus interest charges on monies advanced by the State to meet the construction cash flow requirements of the Facilities, if any, shall be financed from bonds issued by the Authority exclusive of amounts necessary for reserves, interest, or other nonconstruction costs; and be it further

Resolved, That the Legislature approves the necessary conveyances of property to the Authority as more particularly described in the Lease and attachments thereto; and be it further

Resolved, That the Legislature approves the Authority acquiring the Facilities and leasing them to the State and determines that the leasing of the Facilities from the Authority is for a public purpose as authorized by 1964 PA 183, as amended; and be it further

Resolved, That the annual amounts of "True Rental" for the Facilities shall not be less than $5,025,023 and not more than $10,263,528 as shall reflect variations that may occur in the components upon which the appraisal of true rental was based, which amount shall be certified by the appraiser and thereafter approved by the State Administrative Board and the Authority as authorized by 1964 PA 183, as amended; and be it further

Resolved, That the Lease is approved by this concurrent resolution, and the Governor and the Secretary of State are authorized and directed to execute the Lease for and on behalf of the State; and be it further

Resolved, That, by approving the Lease between the State and the Authority, the Legislature agrees to appropriate annually sufficient amounts to pay the rent as obligated pursuant to the Lease; and be it further

Resolved, That a copy of this concurrent resolution be transmitted to the Governor, the Secretary of State, the Authority, and the State Budget Director.

A resolution celebrating Keller L. Coleman's 53 years of faithfulness to the Twelfth Street Missionary Baptist Church.

Whereas, It is with great respect that we offer tribute to honor Keller L. Coleman, Jr., a man who has been a member of the great Twelfth Street Missionary Baptist Church for 53 years. We take pride and pleasure by joining with Twelfth Street Missionary Baptist Church to salute his good works; and

Whereas, Brother Coleman was born September 9, 1932, in Winston-Salem, North Carolina and journeyed to Detroit in 1943 where he worked for the Wayne County Road Commission for 40 years. Mr. Coleman retired from the commission, but he had "a little talk with Jesus" and was told that his work was not done; and

Whereas, Keller L. Coleman, Jr. continues to do the Lords business. He served as Sunday School Superintendent for 26 glorious years and was a faithful worker with the youth department and the senior citizens group. Brother Coleman further served as church clerk, secretary, and trustee as well as chairman of various committees, and church annual days. As his church members say: "he is just an all around loyal and faithful member". Keller is currently serving as Trustee (Emeritus); and

Whereas, Keller Coleman is "President Emeritus" of the Metropolitan District Congress of Christian Education, wherehe served faithfully for 17 years. Additionally, he served in the State and National Congress. Brother Coleman has touched so many lives with his concern, care, gentleness, love for family, friends, young people, community, and his God; and

Whereas, Brother Coleman enjoys his two children, Pauline Coleman-Bray and Kelsey Coleman, who has blessed Grandpa Coleman with ten grandchildren. With his love for youth, we know his grandchildren respect and love him. We also know that Brenda Coleman, his loving wife, stands beside him to assist Keller in his walk with Christ Jesus; and

Whereas, We join the appreciation program and reception celebration for Brother Keller L. A resolution offered as a memorial for Judge Myron Wahls.

Whereas, With deep appreciation for the legacy of service he has left in this state, we honor the memory of Myron Wahls. Through his two decades as a Michigan Court of Appeals and Wayne County Circuit Court Judge, Judge Wahls set standards of commitment and service that will long strengthen our state. We offer our condolences to his beloved family on his passing; and

Whereas, Myron Wahls came to Michigan as a young man. He graduated from Ann Arbor High School in 1950. He received a bachelor's degree from the University of Michigan in 1955 and a law degree from Northwestern University in 1961. In 1988, he earned a master of law degree from the University of Virginia. In 1964, he joined the law firm that eventually became Keith, Conyers, Anderson, Brown, Wahls, Baltimore & Stephens; and

Whereas, Governor William Milliken appointed Myron Wahls a Wayne County Circuit Court Judge, a position he served from 1975 to 1982; and

Whereas, Following his distinguished work in Wayne County, Judge Wahls was appointed by Governor Milliken to the Michigan Court of Appeals in 1982. In this demanding position he channeled his talents and principles to bring justice to the disenfranchised as well as a sense of fairness and dedication to the people of the State of Michigan; and

Whereas, Public service was a major focus of Judge Wahls' life, his livelihood was jazz music. In 1988, he toured Europe with jazz great Lionel Hampton. In 1997, Judge Wahls released a jazz recording titled, "You Be the Judge", whose proceeds benefit the Josephine Ford Cancer Center at Henry Ford Hospital. Clearly, Myron Wahls gave gifts to the State of Michigan and the City of Detroit that will never be forgotten; now, therefore, be it

Resolved by the House of Representatives, That we offer this expression of our highest tribute in memory of Judge Myron Wahls; and be it further

Resolved, That copies of this resolution be transmitted to Judge Wahls' beloved wife Shirleyan Chennault and their entire family as evidence of our condolences.
