We pray for a special wisdom for those who will make decisions--sometimes difficult decisions--that will call for integrity, compassion, justice and truth. A bill to amend 1953 PA 232, entitled "An act to revise, consolidate, and codify the laws relating to probationers and probation officers, to pardons, reprieves, commutations, and paroles, to the administration of correctional institutions, correctional farms, and probation recovery camps, to prisoner labor and correctional industries, and to the supervision and inspection of local jails and houses of correction; to provide for the siting of correctional facilities; to create a state department of corrections, and to prescribe its powers and duties; to provide for the transfer to and vesting in said department of powers and duties vested by law in certain other state boards, commissions, and officers, and to abolish certain boards, commissions, and offices the powers and duties of which are transferred by this act; to prescribe the powers and duties of certain other state departments and agencies; to provide for the creation of a local lockup advisory board; to prescribe penalties for the violation of the provisions of this act; to make certain appropriations; to repeal certain parts of this act on specific dates; and to repeal all acts and parts of acts inconsistent with the provisions of this act," (MCL 791.201 to 791.283) by adding section 68.

A resolution to honor Gerald R. Ferguson, affectionately known as "Jerry the phone guy".
Whereas, It is with great appreciation for his talents and professionalism that the members of this legislative body commend Gerald R. Ferguson upon the occasion of his retirement from his responsibilities with the Legislative Service Bureau's telecommunications unit. His technical expertise has played a key role in how the legislative branch of government conducts its business. We are proud to thank a gentleman known affectionately to many around the Capitol as "the phone guy"; and
Whereas, Jerry Ferguson's career in telecommunications spans an era of remarkable change. He began with Michigan Bell Telephone in 1955 testing local phone lines. In 1986, he brought his experience to the Legislative Service Bureau. Since that time, his technical know-how has been invaluable, not only in helping the Legislature assume responsibilities for its own phone network, but also in adapting to increasing use of computer technology. Jerry has been at the heart of telecommunications, both in handling phone lines, cables, and equipment, and in troubleshooting; and
Whereas, As anyone who knows Jerry Ferguson can attest, however, communications is much more to him than wires and relays. Jerry's warmth has never failed to bring calm and reassurance to those around him. His ready smile, unselfishness, and genuine respect for others have earned him many admirers. We join them in wishing Jerry and his wife of nearly forty years nothing but health and happiness in the years to come; now, therefore, be it
Resolved by the House of Representatives, That we offer this expression of gratitude and admiration to Gerald R. Ferguson as he brings to a close eleven years of hard work with the Legislative Service Bureau and forty-two years serving the people in this state in the field of telecommunications; and be it further

A resolution to express support for the agreement between CSX Corporation and Norfolk Southern Corporation on the acquisition of Conrail assets.
Whereas, Over the past few years, CSX Corporation and Norfolk Southern Corporation have engaged in intense negotiations in seeking to acquire the routes and assets of Conrail, Inc. These merger proposals, involving the most important rail systems in the eastern United States, have taken various turns during this time; and
Whereas, Private and public observers have followed the offers and counteroffers with great interest, as the move to acquire Conrail will have a profound impact on transportation to most of the country's largest markets. Michigan will be strongly affected by the results of the deal; and
Whereas, Recently, CSX and Norfolk Southern announced an agreement on the acquisition of Conrail. In essence, the two corporations will split the routes and other assets of Conrail. Each of the railroads will acquire certain trackage and equipment, and they will share certain other assets and routes; and
Whereas, The joint agreement offers numerous direct benefits to Michigan. Instead of a single railroad dominating the nation's northeast, there will be two variable, strong companies anchoring rail transportation for the region. Michigan's links to major cities in North America are strengthened considerably. Our state's exporters and importers will be able to speed up transit and handling times for our most important goods. The cornerstones of Michigan's economy, automotive manufacturing, agriculture, mining, and chemicals, will all reap benefits from the establishment of rail transportation services made possible by the competition of two strong, balanced, and highly regarded railroads; now, therefore, be it
Resolved by the House of Representatives, That we express support for the agreement between CSX Corporation and Norfolk Southern Corporation on the acquisition of Conrail assets; and be it further

Communications from State Officers
The following communication from the Auditor General was received and read:

Enclosed is a copy of the audit report of the Community Colleges Activities Classification Structure (ACS) for the colleges' fiscal year 1995-96 (July 1, 1995 through June 30, 1996).
This report is being distributed to all community colleges. In compliance with the annual appropriations act, those colleges for which ACS data was subject to audit are required to submit a plan to address the audit recommendations. The act requires each college to submit its plan to the Senate and House Appropriations Committees, the Senate and House Fiscal Agencies, the Departments of Education and Management and Budget, and the Office of the Auditor General within sixty days after release of the audit report.
