SENATE BILL NO. 1137

        Committee on Hunting, Fishing and Forestry.



        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   by amending section 40111 (MCL 324.40111), as added by 1995 PA

   57.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 40111.  (1) Except as otherwise provided in this part

 2    or in  a department  AN order authorized under
              section 40107 

 3    THIS PART, a person shall not take an animal from in or upon a

 4    vehicle.

 5         (2) Except as otherwise provided in this part or in  a

 6     department  AN order authorized under 
                       section 40107  THIS PART,

 7    a person shall not transport or have in possession a firearm in

 8    or upon a vehicle, unless the firearm is unloaded in both barrel

 9    and magazine and enclosed in a case, carried in the trunk of a

10    vehicle, or unloaded in a motorized boat.  HOWEVER, A PERSON MAY

 1    LEAN A FIREARM ON A VEHICLE IF THE VEHICLE'S MOTOR OR ENGINE IS

 2    OFF AND IF THE FIREARM IS RESTING ON THE GROUND, WHETHER OR NOT

 3    THE FIREARM IS LOADED OR ENCLOSED IN A CASE.

 4         (3) Except as otherwise provided in this part, a person

 5    shall not transport or have in possession a bow in or upon a

 6    vehicle, unless the bow is unstrung, enclosed in a case, or car-

 7    ried in the trunk of a vehicle.  HOWEVER, A PERSON MAY LEAN A BOW

 8    ON A VEHICLE IF THE BOW IS RESTING ON THE GROUND, WHETHER OR NOT

 9    THE BOW IS UNSTRUNG OR ENCLOSED IN A CASE.

10         (4) A person shall not hunt or discharge a firearm within

11    150 yards of an occupied building, dwelling, house, residence, or

12    cabin, or any barn or other building used in connection with a

13    farm operation, without obtaining the written permission of the

14    owner, renter, or occupant of the property.
