A bill to amend 1981 PA 180, entitled "Older Michiganians act," (MCL 400.581 to 400.594) by adding section 6l. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 6l. (1) THE OFFICE SHALL ESTABLISH AND ADMINISTER A 2 GRANT PROGRAM TO FUND NONPROFIT LONG-TERM CARE FACILITIES AND 3 PUBLIC AGENCIES THAT PROVIDE A CONTINUUM OF LONG-TERM CARE SERV- 4 ICES IN A SINGLE FACILITY OR FACILITY COMPLEX. THE OFFICE SHALL 5 ENSURE THAT THE GRANT PROGRAM PROMOTES THE CREATION OR EXPANSION 6 OF FACILITIES FOR LONG-TERM CARE THAT INCLUDE ALL LEVELS OF CARE 7 FOR OLDER PERSONS, INCLUDING, BUT NOT LIMITED TO, SKILLED NURSING 8 HOME CARE, ASSISTED LIVING, AND INDEPENDENT LIVING. THE OFFICE 9 SHALL ESTABLISH THE INITIAL GRANT PROGRAM AS A DEMONSTRATION 10 PROJECT THAT FUNDS NOT LESS THAN 5 PROJECTS IN DIFFERENT 11 GEOGRAPHICAL REGIONS OF THE STATE, IF POSSIBLE, WITHIN THE YEAR 06502'98 CPD 2 1 IMMEDIATELY PRECEDING THE EFFECTIVE DATE OF THE AMENDATORY ACT 2 THAT ADDED THIS SECTION. THE OFFICE SHALL AWARD NOT MORE THAN 3 20% OF THE TOTAL AMOUNT OF GRANT FUNDS AVAILABLE TO ANY 1 4 PROJECT. THE OFFICE MAY PROMULGATE RULES TO IMPLEMENT THE GRANT 5 PROGRAM ESTABLISHED UNDER THIS SECTION. 6 (2) ONLY AN ORGANIZATION THAT IS 1 OF THE FOLLOWING AND THAT 7 HAS TAX-EXEMPT STATUS UNDER SECTION 501(c)(3) OF THE INTERNAL 8 REVENUE CODE OF 1986 OR IS A STATE OR LOCAL GOVERNMENTAL AGENCY 9 IS ELIGIBLE TO APPLY FOR A GRANT UNDER THIS SECTION: 10 (A) A NURSING HOME, HOME FOR THE AGED, OR COUNTY MEDICAL 11 CARE FACILITY LICENSED UNDER ARTICLE 17 OF THE PUBLIC HEALTH 12 CODE, 1978 PA 368, MCL 333.20101 TO 333.22260. 13 (B) A HOSPITAL LICENSED UNDER ARTICLE 17 OF THE PUBLIC 14 HEALTH CODE, 1978 PA 368, MCL 333.20101 TO 333.22260. 15 (C) AN ADULT FOSTER CARE FACILITY LICENSED UNDER THE ADULT 16 FOSTER CARE FACILITY LICENSING ACT, 1979 PA 218, MCL 400.701 TO 17 400.737. 18 (D) AN INSTITUTION OF HIGHER EDUCATION. 19 (E) AN AREA AGENCY ON AGING ESTABLISHED UNDER THIS ACT. 20 (F) A STATE VETERANS' HOME ESTABLISHED UNDER 1885 PA 152, 21 MCL 36.1 TO 36.12. 22 (G) A COMMUNITY MENTAL HEALTH AGENCY AS DEFINED IN SECTION 23 100 OF THE MENTAL HEALTH CODE, 1974 PA 258, MCL 330.1100. 24 (3) THE OFFICE SHALL ESTABLISH A GRANT PROPOSAL REVIEW COM- 25 MITTEE TO PROCESS APPLICATIONS FOR GRANTS UNDER THIS SECTION. 26 THE REVIEW COMMITTEE SHALL REVIEW EACH GRANT APPLICATION RECEIVED 27 UNDER THIS SECTION, ADVISE THE OFFICE WHETHER OR NOT THE 06502'98 3 1 APPLICATION IS COMPLETE, AND MAKE A RECOMMENDATION REGARDING THE 2 APPLICANT TO THE OFFICE. THE OFFICE SHALL INCLUDE AT LEAST ALL 3 OF THE FOLLOWING ON THE GRANT PROPOSAL REVIEW COMMITTEE: 4 (A) A REPRESENTATIVE OF THE OFFICE. 5 (B) A REPRESENTATIVE OF ORGANIZATIONS THAT ADVOCATE FOR 6 OLDER PERSONS. 7 (C) A NURSING HOME RESIDENT. 8 (D) A NURSING HOME ADMINISTRATOR. 9 (E) A FAMILY MEMBER OF A NURSING HOME RESIDENT. 10 (4) THE OFFICE SHALL PUBLISH INFORMATION ABOUT THE GRANT 11 PROGRAM ESTABLISHED UNDER THIS SECTION IN A MANNER CONSIDERED BY 12 THE OFFICE AS BEST CALCULATED TO GIVE NOTICE TO PERSONS LIKELY TO 13 BE INTERESTED IN THE GRANT PROGRAM. THE OFFICE SHALL INCLUDE IN 14 THE PUBLISHED INFORMATION AT LEAST ALL OF THE FOLLOWING: 15 (A) A DESCRIPTION OF THE GRANT PROGRAM, INCLUDING, BUT NOT 16 LIMITED TO, ITS GOALS AND EXPECTATIONS. A PRIMARY GOAL OF THE 17 GRANT PROGRAM IS TO ALLOW OLDER COUPLES TO REMAIN TOGETHER 18 LONGER, EVEN IF 1 PARTNER REQUIRES MORE LONG-TERM CARE THAN THE 19 OTHER. 20 (B) THE ORGANIZATIONS THAT ARE ELIGIBLE TO APPLY. 21 (C) HOW THE PROCESS FOR REVIEWING APPLICATIONS AND AWARDING 22 GRANTS WILL WORK. 23 (D) HOW TO APPLY FOR A GRANT. 24 (5) THE OFFICE SHALL DEVELOP AND DISTRIBUTE AN APPLICATION 25 FORM FOR THE GRANT PROGRAM ESTABLISHED UNDER THIS SECTION. THE 26 OFFICE SHALL REQUEST AT LEAST ALL OF THE FOLLOWING INFORMATION IN 27 THE APPLICATION FORM: 06502'98 4 1 (A) A DESCRIPTION OF THE APPLICANT ORGANIZATION. 2 (B) A BRIEF GENERAL DESCRIPTION OF HOW THE APPLICANT'S 3 PROJECT WILL ADDRESS THE PROBLEM OF CONTINUUM OF CARE FOR OLDER 4 PERSONS. 5 (C) AT LEAST ALL OF THE FOLLOWING SPECIFIC INFORMATION 6 REGARDING THE PROJECT: 7 (i) THE PROJECT'S PRINCIPAL OBJECTIVES AND EXPECTED 8 OUTCOMES. 9 (ii) THE TIMETABLE FOR THE PROJECT. 10 (iii) THE COMPONENTS OF THE INTERVENTION CONTEMPLATED BY THE 11 PROJECT. 12 (iv) THE RISKS AND LIMITATIONS OF THE PROJECT. 13 (v) THE ESTIMATED TOTAL COST OF THE PROJECT OR A BUDGET FOR 14 THE PROJECT. 15 (vi) THE QUALIFICATIONS OF THE APPLICANT ORGANIZATION TO 16 DEVELOP AND IMPLEMENT THE PROJECT, INCLUDING, BUT NOT LIMITED TO, 17 THE QUALIFICATIONS OF THE PERSONNEL WHO WILL IMPLEMENT AND ADMIN- 18 ISTER THE PROJECT. 19 (vii) HOW THE APPLICANT ORGANIZATION WILL QUANTIFY AND DIS- 20 SEMINATE THE RESULTS OF THE PROJECT. 21 (viii) OTHER INFORMATION CONSIDERED RELEVANT BY THE OFFICE. 22 (6) THE OFFICE SHALL SUBMIT AN ANNUAL, WRITTEN REPORT TO THE 23 LEGISLATURE ON THE GRANT PROGRAM ESTABLISHED UNDER THIS SECTION. 24 THE OFFICE SHALL INCLUDE AT LEAST ALL OF THE FOLLOWING INFORMA- 25 TION IN THE REPORT: 26 (A) THE NAMES AND ADDRESSES OF THE APPLICANT ORGANIZATIONS 27 AWARDED GRANTS UNDER THE PROGRAM. 06502'98 5 1 (B) THE AMOUNT OF EACH GRANT AWARDED, AND THE COST OF EACH 2 PROJECT FUNDED. 3 (C) A DESCRIPTION OF EACH PROJECT'S PRINCIPAL OBJECTIVES AND 4 EXPECTED OUTCOMES. 5 (D) THE RESULTS OF EACH PROJECT, AS FAR AS THE OFFICE CAN 6 DETERMINE THE RESULTS AT THE TIME OF THE REPORT. 06502'98 Final page.
