A bill to amend 1967 PA 150, entitled "Michigan military act," by amending section 382 (MCL 32.782), as amended by 1992 PA 307. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 382. (1) The state military board may dispose of 2 Michigan national guard armories, facilities, or lands under the 3 jurisdiction of the state military establishment if, in the state 4 military board's judgment, the armory, facility, or land is obso- 5 lete, inadequate, unusable, or no longer is required for Michigan 6 national guard purposes. The BEFORE DISPOSING OF THE PROPERTY, 7 THE STATE MILITARY BOARD SHALL GIVE NOTICE OF THE PROPOSED DIS- 8 POSAL TO THE CITY, VILLAGE, OR TOWNSHIP IN WHICH IT IS LOCATED. 9 THAT CITY, VILLAGE, OR TOWNSHIP HAS THE FIRST RIGHT OF REFUSAL TO 10 PURCHASE THE ARMORY, FACILITY, OR LAND FOR FAIR MARKET VALUE. IF 11 THAT MUNICIPALITY DECLINES TO PURCHASE THE ARMORY, FACILITY, OR 06700'98 DRM 2 1 LAND, THE disposal shall be by sale for fair market value or by 2 exchange at fair market value for other lands owned by private 3 persons or entities, local units of government, or the federal 4 government. 5 (2) Disposal of armories, facilities, or land under this 6 section shall be in accordance with policies established by the 7 state military board and in accordance with procedures estab- 8 lished by the department of management and budget. Each disposal 9 action also shall be subject to approval by the state administra- 10 tive board. 11 (3) Not later than July 31, 1993, and July 31 of each year 12 thereafter, the department of military affairs shall report to 13 the standing committees of the Senate and House of 14 Representatives that are responsible for legislation concerning 15 military affairs, and to the senate and house appropriations com- 16 mittees, as to the actions taken by the department under this 17 section during the preceding reporting period. 06700'98 Final page.
