A bill to authorize the department of transportation to convey certain state owned property in Delta county; to prescribe conditions for the conveyance; and to provide for disposition of the revenue derived from the conveyance. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. The department of transportation, on behalf of the 2 state, shall convey to Delta county, for consideration of $1.00, 3 certain real property under the jurisdiction of the department of 4 transportation and located in Ford River township, Delta county, 5 Michigan, and more particularly described as: 6 Portion of NE1/4 of NE1/4 of Sec 27 T37N R24W com at NE cor 7 Sec 27 th S87ø 31'W on N line of Sec 27, 24.77' to POB; th S87ø 8 31'W on N line of Sec 27, 703.85'; th S02ø 29'E, 1034.87'+ to 9 point on N line of M35 ROW as recorded L132 P291; th N31ø 43'40"W 10 on aforementioned ROW 1251.89'+ to POB; excluding parcel recorded 06285'98 DRM 2 1 L132 P291 as: com at NE cor Sec 27, th S02ø 36'E on E line of 2 Sec 27 95.4' to M35 construction centerline, th S31ø 43'40"W on 3 said centerline 212.32', th N58ø 16'20"W 75.00' to POB of parcel, 4 th S31ø 43'40"W along said ROW 300.00', th N58ø 16'20"W 125.00', 5 th N31ø 43'40"E 300.00', th S58ø 16'20"E 125.00' to POB. 6 Described portion containing 7.5+ acres. 7 Sec. 2. The conveyance authorized by this act shall provide 8 for both of the following: 9 (a) That the property shall be used exclusively for public 10 park and recreation purposes, and that upon termination of that 11 use or use for any other purpose, the state may reenter and 12 repossess the property, terminating the grantee's estate in the 13 property. 14 (b) That if the grantee disputes the state's exercise of its 15 right of reentry and fails to promptly deliver possession of the 16 property to the state, the attorney general, on behalf of the 17 state, may bring an action to quiet title to, and regain posses- 18 sion of, the property. 19 Sec. 3. The conveyance authorized by this act shall be by 20 quitclaim deed approved by the attorney general and shall reserve 21 to the state all rights to coal, oil, gas, and other nonmetallic 22 minerals found on, within, or under the conveyed property. 23 Sec. 4.
