A bill to amend 1939 PA 280, entitled "The social welfare act," by amending section 107 (MCL 400.107). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 107. (1) In establishing financial eligibility for 2 the medically indigent as defined in section106 (2)106(1)(B), 3 income shall be disregarded in accordance with standards estab- 4 lished for the related categorical assistance program. 5 Additional income shall be applied against BOTH OF THE 6 FOLLOWING: 7 (A)(i) theTHE cost of medical care not authorized under 8 this act., and (ii) the9 (B) THE cost of services authorized under this act, in 10 excess of the basic amount. 00873'97 MGM 2 1 (2) For medical assistance only, income shall include the 2 amount of contributionwhichTHAT an estranged spouse or parent 3 for a minor child is making to the applicant according to the 4 standards of thestatedepartment, or pursuant to a court 5 determination, if there is such a determination.Nothing in6this section shall eliminate the responsibility of support estab-7lished in section 76 for cash assistance received under this8act.9 (3) IN ESTABLISHING FINANCIAL ELIGIBILITY FOR THE MEDICALLY 10 INDIGENT AS DEFINED IN SECTION 106(1)(B), THE DEPARTMENT SHALL 11 NOT TAKE INTO ACCOUNT THE INCOME AND RESOURCES OF ANY PERSON 12 OTHER THAN THE FOLLOWING: 13 (A) THE APPLICANT. 14 (B) THE SPOUSE OF THE APPLICANT. 15 (C) THE PARENT OR PARENTS OF AN APPLICANT WHO IS UNDER AGE 16 21, OR WHO IS OVER AGE 21 AND BLIND OR DISABLED. 00873'97 Final page.
