A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 725 (MCL 257.725), as amended by 1991 PA 19. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 725. (1) Upon receipt of a written application and 2 good cause being shown, a jurisdictional authority may issue a 3 written special permit authorizing an applicant to operate upon 4 or remove from a highway maintained by that jurisdictional 5 authority a vehicle or combination of vehicles that are any of 6 the following: 7 (a) Of a size, weight, or load exceeding the maximum speci- 8 fied in this chapter. 9 (b) Otherwise not in conformity with this chapter. 10 (2) The application for a special permit shall be on a form 11 prescribed by the jurisdictional authority and shall specifically 03902'97 TJS 2 1 describe the vehicle or vehicles and load to be operated or moved 2 and the particular highways upon which the special permit to 3 operate is requested. 4 (3) A jurisdictional authority may issue a special permit 5 authorizing the operation of the following upon a highway: 6 (a) Traction engines or tractors having movable tracks with 7 transverse corrugations upon the periphery of those movable 8 tracks on farm tractors. 9 (b) Other farm machinery otherwise prohibited under this 10 chapter. 11 (4) A special permit shall specify the trip or trips and 12 date or dates for which it is valid and the jurisdictional 13 authority granting the special permit may restrict or prescribe 14 conditions of operation of a vehicle or vehicles, if necessary, 15 to protect the safety of the public or to ensure against undue 16 damage to the road foundations, surfaces, structures, or instal- 17 lations, and may require a reasonable inspection fee and other 18 security as that jurisdictional authority determines necessary to 19 compensate for damages caused by the movement. A special permit 20 may be issued on an annual basis. THE FEE CHARGED BY A JURISDIC- 21 TIONAL AUTHORITY FOR AN INTRASTATE OR AN OUT-OF-STATE VEHICLE FOR 22 A SINGLE TRIP SHALL BE NOT LESS THAN $50.00 AND FOR MULTIPLE 23 TRIPS OR ON AN ANNUAL BASIS NOT LESS THAN $100.00. 24 (5) A person may transport telephone, telegraph, or electric 25 poles of a greater length than otherwise authorized over the 26 highways in the construction, maintenance, or repair of 03902'97 3 1 telephone, telegraph, or electric lines pursuant to a special 2 permit issued under this section. 3 (6) A person may transport concrete pipe of a greater width 4 than otherwise authorized over highways pursuant to a special 5 permit issued under this section. 6 (7) A special permit issued under this section shall be car- 7 ried in the vehicle or combination of vehicles to which it refers 8 and shall be open to inspection by a police officer or authorized 9 agent of an authority granting the special permit. A person 10 shall not violate any of the terms or conditions of the special 11 permit. 12 (8) A person who violates this section is responsible for a 13 civil infraction. 14 (9) A jurisdictional authority issuing a special permit to 15 move a mobile home under this section and a person who is issued 16 a special permit to move a mobile home under this section are 17 subject to section 719a. 18 (10) As used in this section, "jurisdictional authority" 19 means the state transportation department, a county road commis- 20 sion, or a local authority having jurisdiction over a highway 21 upon which a vehicle is proposed to be moved pursuant to a permit 22 required under this section. 03902'97 Final page.
