A bill to amend 1933 (Ex Sess) PA 8, entitled "The Michigan liquor control act," by amending section 4 (MCL 436.4). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 4.Exceptions to act. The provisions of thisTHIS 2 actshallDOES notbe construed to prevent theAPPLY TO THE 3 FOLLOWING: 4 (A) THE manufacture of cider from fruit,for the purpose 5 of making vinegar,and non-intoxicating cider and fruit juice 6 for use and sale, and cider and fruit juiceshall be deemed7non-intoxicating within the meaning of this actwhen usedand/8 or sold, OR BOTH, within 30 days afterthemanufacture. 9thereof; and this act shall not apply to wine03475'97 LBO 2 1 (B) BEER, WINE, or cider of any alcoholic content made on 2 the premises by the owner or lessee ofsuchTHOSE premises 3 providedsuchTHOSE premises are used and occupied bysuch4 THAT owner or lessee as a dwelling andsuchTHE BEER, wine, or 5 cider is made for family use and home consumption.; or to pre-6vent the7 (C) THE sale,orgift, or keeping and storing for sale by 8 druggists and general merchants and others ofany of themedic- 9 inal preparations manufactured in accordance with the formulas 10 prescribed by the United States pharmacopoeia and national formu- 11 lary, patent or proprietary preparations, and other bona fide 12 medicinal and technical preparations,whichTHAT contain no 13 more alcohol than is necessary to extract the medicinal proper- 14 ties of the drugs contained insuchTHOSE preparations;and 15 no more alcohol than is necessary to hold the medicinal agents in 16 solution and to preservethe sameTHEM,whichTHAT are manu- 17 factured and sold as medicine and not as beverages, THAT are 18 unfit for use for beverage purposes, and the sale of which does 19 notnowrequire the payment of a United States liquor dealer's 20 tax.; or to prevent the21 (D) THE manufacture and sale of tinctures or of toilet, 22 medicinal, and antiseptic preparations and solutions THAT ARE not 23 intended for internal human usenorOR THAT ARE NOT INTENDED to 24 be sold as beverages,and whichTHAT are unfit for beverage 25 purposes, and upon the outside of each bottle, box, or package of 26 which is CONSPICUOUSLY AND LEGIBLY printed intheEnglish 03475'97 3 1language, conspicuously and legibly,the quantity by volume of 2 alcohol insuchTHOSE preparations.; or to prevent the3 (E) THE manufacture and keeping for sale of the food product 4 known as flavoring extractswhich shall be soTHAT ARE manufac- 5 tured and sold for cooking, culinary, or flavoring purposes,6 and are unfit for use as a beverage or for beverage purposes,:7Provided, That it shall not be lawful toEXCEPT THAT A PERSON 8 SHALL NOT manufacture or sell any toilet, medicinal, or antisep- 9 tic preparations or solutions, or any flavoring extracts or 10 patent or proprietary medicines or preparations, IF the manufac- 11 ture and sale ofwhich nowTHOSE ITEMS requires the payment of 12 a United States liquor dealer's tax,except ashereinpro- 13 vided: Provided further, That nothing in this act shall apply14to theIN THIS ACT. 15 (F) THE manufactureand/or sale, OR BOTH, of ethyl, 16 mechanical, or industrial alcohol, not used for or made unfit for 17 beverage purposes.: And provided further, That this act shall18not apply to the19 (G) THE purchase of alcoholic liquoras defined in this20act,for use in the manufacture of toilet, medicinal, or anti- 21 septic preparations or solutions, or any flavoring extract or 22 patent or proprietary medicines or preparations, by a manufac- 23 turer usingsuchalcoholic liquor exclusively forsuchTHE 24 manufacturing purposes anddulylicensedthereforby the com- 25 mission; saidFOR THAT USE.
