HOUSE BILL No. 4830 May 27, 1997, Introduced by Reps. Agee, Oxender, LaForge, Brater, Hanley, Mans, Wetters, Cherry, Schauer, Anthony, Baade, Prusi, Profit, Tesanovich, Parks, Vaughn, Scott, Murphy, Wojno, Hale, Freeman, Callahan and Jellema and referred to the Committee on Appropriations. A bill to make appropriations to provide state funding for certain school districts levying certain debt millage; and to prescribe certain duties of certain state departments. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Department" means the department of education. 3 (b) "Infrastructure debt millage" means millage levied to 4 repay bonds issued under section 1351a of the revised school 5 code, 1976 PA 451, MCL 380.1351a, for new construction, major 6 renovations, or technology retrofitting of school buildings. 7 (c) "Major renovation" means to restore or remodel an area 8 or areas of a school district building to an effective and effi- 9 cient operational level, including, but not limited to, 10 re-roofing, heat/air exchange system, electrical, plumbing, 11 structural, renovation to meet requirements of laws concerning 02077'97 TAV 2 1 persons with disabilities, energy efficiency improvements, or 2 instructional space redesign. 3 (d) "Membership pupil" means a pupil counted in membership 4 in a school district under the state school aid act of 1979, 1979 5 PA 94, MCL 388.1601 to 388.1772. 6 (e) "School district" means a school district or local act 7 school district, as those terms are defined in the revised school 8 code, 1976 PA 451, MCL 380.1 to 380.1852. 9 (f) "State fiscal year" means the fiscal year that commences 10 October 1 and continues through September 30. 11 (g) "Taxable value" means that term as defined in section 6 12 of the state school aid act of 1979, 1979 PA 94, MCL 388.1606. 13 (h) "Taxable value per membership pupil" means that term as 14 defined in section 20 of the state school aid act of 1979, 1979 15 PA 94, MCL 388.1620. 16 (i) "Technology retrofitting" means to remodel an existing 17 area in a building to house a technology program, to adapt the 18 existing electrical system to handle increased electrical load 19 from technology usage, or to add cabling or wireless capability 20 to provide for voice, video, or data transmission to, or recep- 21 tion from, multiple sites within the building. 22 Sec. 3. There is appropriated from the general fund an 23 amount not to exceed $_____ for the 1997-98 state fiscal year to 24 make payments to school districts under this act. The department 25 shall cause payments to be made to school districts under this 26 act in the same manner and on the same schedule as provided under 02077'97 3 1 the state school aid act of 1979, 1979 PA 94, MCL 388.1601 to 2 388.1772. 3 Sec. 5. (1) Subject to subsection (2), from the appropria- 4 tion in section 3, there is allocated to each school district 5 that levies at least 2 mills of infrastructure debt millage an 6 amount per membership pupil sufficient to guarantee the school 7 district a combined state-local yield or gross allowance of 8 $111,000.00 per membership pupil for each mill of infrastructure 9 debt millage levied by the school district. The net allocation 10 for each school district shall be an amount per membership pupil 11 computed by subtracting from the gross allowance for the school 12 district under this section the product of the school district's 13 taxable value per membership pupil and the number of mills of 14 infrastructure debt millage used for computing the school 15 district's gross allowance. All calculations under this section 16 shall be made by the department using the number of membership 17 pupils for the school year ending in the immediately preceding 18 state fiscal year, the number of mills of infrastructure debt 19 millage levied by the school district in the calendar year ending 20 in the immediately preceding state fiscal year, and the taxable 21 value of the school district for the calendar year ending in the 22 immediately preceding state fiscal year. 23 (2) The total amount allocated to any 1 school district 24 under this act for a state fiscal year shall not exceed 25 $3,000,000.00 for that state fiscal year. 26 Sec. 7. To receive funding under this act, a school 27 district shall provide to the department in the form and manner 02077'97 4 1 prescribed by the department all information the department 2 considers necessary to verify the school district's eligibility 3 for payments under this act and to calculate payments under this 4 act. 5 Sec. 9. The department may promulgate rules to implement 6 this act under the administrative procedures act of 1969, 1969 PA 7 306, MCL 24.201 to 24.328. 02077'97 Final page. TAV
