A bill to amend the Initiated Law of 1996, entitled "Michigan gaming control and revenue act," by amending section 12 (MCL 432.212). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 12. (1) Section 12. Wagering Tax; Rate; 2 Distribution. (a) A wagering tax is imposed on the gross reve- 3 nue received by the licensee from gaming authorized under this 4 act at the rate of 18%. 5 (2) (b) The EXCEPT FOR THE wagering tax, plus all other 6 fees, fines, and charges shall be deposited into the state casino 7 gaming fund in the department of treasury. Such tax is to be 8 remitted daily by the holder of a casino license to the depart- 9 ment of treasury by electronic wire transfer of funds. All of 10 the ordinary, necessary, and reasonable expenses of operating the 11 board shall be deducted from the fund. The fund shall be 03245'97 VPW 2 1 distributed periodically in accordance with the provisions of 2 this act pursuant to a schedule and methodology which shall be 3 mutually agreeable to the department of treasury and the city. 4 (c) The state casino gaming fund shall be allocated as 5 follows: 6 (3) (1) EXCEPT AS PROVIDED IN SUBSECTION (6), 55% to OF 7 THE WAGERING TAX SHALL BE REMITTED DAILY BY THE LICENSEE BY ELEC- 8 TRONIC WIRE TRANSFER TO AN ACCOUNT THAT the city in which a THE 9 casino is located for use in connection with HAS DESIGNATED TO 10 BE USED FOR the following: 11 (A) (i) the THE hiring, training and deployment of street 12 patrol officers. ; 13 (B) (ii) neighborhood NEIGHBORHOOD and downtown economic 14 development programs designed to create local jobs. ; 15 (C) (iii) public PUBLIC safety programs such as emergency 16 medical services, fire department programs, and street lighting. 17 ; 18 (D) (iv) antigang ANTIGANG and youth development programs. 19 ; and 20 (E) (v) other OTHER programs which THAT are designed to 21 contribute to the improvement of the quality of life in the 22 city. 23 (4) (2) 45% to the state FORTY-FIVE PERCENT OF THE WAGER- 24 ING TAX SHALL BE REMITTED DAILY BY THE LICENSEE BY ELECTRONIC 25 WIRE TRANSFER TO THE STATE CASINO GAMING FUND to be deposited in 26 the State School Aid Fund STATE SCHOOL AID FUND to provide 27 additional funds for K-12 classroom education. 03245'97 3 1 (5) (d) Funds from this act shall not be used to supplant 2 existing state appropriations or local expenditures. 3 (6) IF THE FINANCIAL INSTITUTION DESIGNATED BY THE CITY IS 4 UNABLE TO RECEIVE AN ELECTRONIC WIRE TRANSFER OF FUNDS ON THE DAY 5 THE LICENSEE ATTEMPTS TO TRANSFER THE FUNDS, THE LICENSEE SHALL 6 TRANSFER THE FUNDS ON THE FOLLOWING DAY. 03245'97 Final page.
