A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 80129, 81120, and 82113 (MCL 324.80129, 324.81120, and 324.82113), as added by 1995 PA 58. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 80129. (1) All records of the secretary of state made 2 or kept pursuant to this part shall be public records except as 3 otherwise provided in this SECTION AND THIS part. Annually the 4 secretary of state shall compile all registration numbers and 5 names of persons to whom those numbers have been assigned. This 6 compilation shall be furnished without cost to all police agen- 7 cies requesting a copy of the compilation. Individuals desiring 8 copies of the annual registration list may obtain the list by 9 payment of a reasonable fee established by the secretary of 10 state. 02872'97 TJS 2 1 (2) AT THE TIME OF INITIAL OR RENEWAL REGISTRATION OF A 2 VESSEL, THE SECRETARY OF STATE, THROUGH THE APPLICATION FOR INI- 3 TIAL OR RENEWAL OF REGISTRATION FORM UNDER SECTION 80124, SHALL 4 INFORM A PERSON OF THE RIGHT TO HAVE HIS OR HER NAME REMOVED FROM 5 THE LIST OF REGISTRATIONS THAT MAY BE AVAILABLE FOR PURCHASE 6 UNDER THIS SECTION. INFORMATION PERTAINING TO A PERSON WHOSE 7 NAME IS REMOVED FROM THE LIST OF REGISTRATIONS UNDER THIS PART 8 SHALL BE CONFIDENTIAL AND SHALL ONLY BE MADE AVAILABLE TO THE 9 PERSON WHO HAS HAD HIS OR HER NAME REMOVED, LAW ENFORCEMENT AGEN- 10 CIES, AND THE DEPARTMENT AND THE SECRETARY OF STATE AND SHALL 11 REMAIN CONFIDENTIAL UNTIL THE PERSON NOTIFIES THE DEPARTMENT AND 12 THE SECRETARY OF STATE IN WRITING TO REMOVE THE INFORMATION FROM 13 THE CONFIDENTIAL FILE. 14 Sec. 81120. (1) Records of the department and the depart- 15 ment of state made and kept pursuant to this part shall be public 16 records, except as otherwise provided in this SECTION AND THIS 17 part. 18 (2) AT THE TIME OF REGISTRATION OF AN ORV, THE SECRETARY OF 19 STATE SHALL INFORM A PERSON OF THE RIGHT TO HAVE HIS OR HER NAME 20 REMOVED FROM THE RECORDS THAT MAY BE AVAILABLE FOR PURCHASE. 21 INFORMATION PERTAINING TO A PERSON WHOSE NAME IS REMOVED FROM THE 22 RECORDS UNDER THIS PART SHALL BE CONFIDENTIAL AND SHALL ONLY BE 23 MADE AVAILABLE TO THE PERSON WHO HAS HAD HIS OR HER NAME REMOVED, 24 LAW ENFORCEMENT AGENCIES, AND THE DEPARTMENT AND THE SECRETARY OF 25 STATE AND SHALL REMAIN CONFIDENTIAL UNTIL THE PERSON NOTIFIES THE 26 DEPARTMENT AND THE SECRETARY OF STATE IN WRITING TO REMOVE THE 27 INFORMATION FROM THE CONFIDENTIAL FILE. 02872'97 3 1 Sec. 82113. (1) The owner of a snowmobile having been 2 issued a certificate of registration for the snowmobile shall 3 attach in a permanent manner to each side of the forward half of 4 the snowmobile the registration decal assigned to that 5 snowmobile. 6 (2) Not earlier than 90 days before the expiration date of a 7 certificate, a registration decal or other device may be issued 8 indicating that the certificate of registration is in full force 9 and effect. 10 (3) A certificate of registration shall expire pursuant to 11 section 82105. 12 (4) The department of state may award a certificate of 13 number directly or may authorize a person to act as its agent for 14 the awarding of a certificate of number. 15 (5)RecordsEXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, 16 RECORDS of the department of state made or kept pursuant to this 17 part shall be made available to the public in compliance with the 18 freedom of information act,Act No. 442 of the Public Acts of191976, being sections 15.231 to 15.246 of the Michigan Compiled20Laws1976 PA 442, MCL 15.231 TO 15.246. 21 (6) AT THE TIME OF INITIAL OR RENEWAL REGISTRATION OF A 22 SNOWMOBILE, THE SECRETARY OF STATE SHALL INFORM A PERSON OF THE 23 RIGHT TO HAVE HIS OR HER NAME REMOVED FROM THE LIST OF REGISTRA- 24 TIONS THAT MAY BE AVAILABLE FOR PURCHASE.
