A bill to amend 1968 PA 357, entitled "An act to prescribe the powers, duties and functions of the state officers' compensation commission; and to prescribe the powers and duties of the legislature in relation to the commission," by amending sections 6 and 7 (MCL 15.216 and 15.217). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 6. The SUBJECT TO SECTION 7, THE commission shall 2 determine the salaries and expense allowance of the governor, 3 lieutenant governor, the ATTORNEY GENERAL, SECRETARY OF STATE, 4 justices of the supreme court, and the members of the 5 legislature. and THE COMMISSION SHALL file its determinations 6 with the clerk of the house of representatives, the secretary of 7 the senate, and the director of the department of management and 8 budget after December 1 and before December 31, of each even 9 numbered year and shall furnish copies to the governor, the 02217'97 JLB 2 1 lieutenant governor, ATTORNEY GENERAL, SECRETARY OF STATE, 2 justices of the supreme court, and members of the legislature. 3 Sec. 7. The determinations of the commission shall be 4 effective January 1 of the year following their filing and shall 5 be the compensation and expense allowances of the governor, lieu- 6 tenant governor, justices of the supreme court and members of the 7 legislature unless the legislature, by ONLY UPON THE ADOPTION OF 8 SEPARATE concurrent resolution adopted RESOLUTIONS, 1 EACH FOR 9 THE EXECUTIVE, JUDICIAL, AND LEGISLATIVE BRANCHES OF GOVERNMENT, 10 by a 2/3 MAJORITY vote of the members elected to and serving 11 prior to February 1 of the year following the filing of the 12 determinations, rejects either the entire determinations or spe- 13 cific determinations for specific positions. In case of rejec- 14 tion the existing salary and expense allowances shall prevail 15 retroactive to January 1 IN EACH HOUSE. BEGINNING IN 1999 AND 16 EVERY 4 YEARS AFTER 1999, THE HOUSE OF REPRESENTATIVES SHALL 17 ORIGINATE THE CONCURRENT RESOLUTIONS AND SHALL VOTE FIRST ON EACH 18 SEPARATE RESOLUTION. BEGINNING IN 2001 AND EVERY 4 YEARS AFTER 19 2001, THE SENATE SHALL ORIGINATE THE CONCURRENT RESOLUTIONS AND 20 SHALL VOTE FIRST ON EACH SEPARATE RESOLUTION. THE CONCURRENT 21 RESOLUTIONS DESCRIBED IN THIS SECTION SHALL BE VOTED UPON BY THE 22 FIRST HOUSE ON OR BEFORE MARCH 1. THOSE RESOLUTIONS THAT RECEIVE 23 AN AFFIRMATIVE VOTE IN THE FIRST HOUSE SHALL BE VOTED UPON BY THE 24 SECOND HOUSE ON OR BEFORE APRIL 1. IF A CONCURRENT RESOLUTION IS 25 ADOPTED, THEN THOSE DETERMINATIONS SHALL BECOME EFFECTIVE FOR THE 26 LEGISLATIVE SESSION IMMEDIATELY FOLLOWING THE NEXT GENERAL 27 ELECTION. IF THE RECOMMENDATIONS OF THE COMMISSION ARE NOT 02217'97 3 1 ADOPTED, THE EXISTING SALARY AND EXPENSE ALLOWANCES SHALL REMAIN 2 IN EFFECT. 3 Enacting section 1. This amendatory act does not take 4 effect unless Senate Joint Resolution ____ or House Joint 5 Resolution ____ (request no. 02216'97) of the 89th Legislature 6 becomes a part of the state constitution of 1963 as provided in 7 section 1 of article XII of the state constitution of 1963. 02217'97 Final page.
