A bill to amend 1978 PA 368, entitled "Public health code," (MCL 333.1101 to 333.25211) by adding part 94. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 PART 94. OSTEOPOROSIS EDUCATION 2 SEC. 9401. THIS PART SHALL BE KNOWN AND MAY BE CITED AS THE 3 "OSTEOPOROSIS PREVENTION AND TREATMENT EDUCATION ACT". 4 SEC. 9403. THE DEPARTMENT MAY DO ALL OF THE FOLLOWING: 5 (A) ADD SUFFICIENT QUALIFIED STAFF TO IMPLEMENT THE OSTEOPO- 6 ROSIS PREVENTION AND TREATMENT EDUCATION PROGRAM ESTABLISHED BY 7 SECTION 9405. 8 (B) PROVIDE APPROPRIATE TRAINING FOR STAFF OF THE OSTEOPO- 9 ROSIS PREVENTION AND TREATMENT EDUCATION PROGRAM. 10 (C) WORK TO IMPROVE THE CAPACITY OF COMMUNITY-BASED SERVICES 11 AVAILABLE TO OSTEOPOROSIS PATIENTS. 01075'97 * CPD 2 1 (D) WORK WITH OTHER STATE AND LOCAL GOVERNMENTAL OFFICES, 2 COMMUNITY AND BUSINESS LEADERS, COMMUNITY ORGANIZATIONS, HEALTH 3 CARE AND HUMAN SERVICE PROVIDERS, AND NATIONAL OSTEOPOROSIS 4 ORGANIZATIONS TO COORDINATE EFFORTS AND MAXIMIZE STATE RESOURCES 5 IN THE AREAS OF PREVENTION, EDUCATION, AND TREATMENT OF 6 OSTEOPOROSIS. 7 (E) IDENTIFY AND, WHEN APPROPRIATE, REPLICATE OR USE SUC- 8 CESSFUL OSTEOPOROSIS PROGRAMS AND PROCURE RELATED MATERIALS AND 9 SERVICES FROM ORGANIZATIONS WITH APPROPRIATE EXPERTISE AND KNOWL- 10 EDGE OF OSTEOPOROSIS. 11 SEC. 9405. (1) THE DEPARTMENT SHALL ESTABLISH AN OSTEOPO- 12 ROSIS PREVENTION AND TREATMENT EDUCATION PROGRAM. 13 (2) AS PART OF THE PROGRAM ESTABLISHED UNDER SUBSECTION (1), 14 THE DEPARTMENT SHALL DESIGN AND IMPLEMENT STRATEGIES FOR RAISING 15 PUBLIC AWARENESS ON THE CAUSES AND NATURE OF OSTEOPOROSIS, PER- 16 SONAL RISK FACTORS, VALUE OF PREVENTION AND EARLY DETECTION, AND 17 OPTIONS FOR DIAGNOSING AND TREATING OSTEOPOROSIS. 18 (3) AS PART OF THE PROGRAM ESTABLISHED UNDER SUBSECTION (1), 19 THE DEPARTMENT SHALL DEVELOP AND WORK WITH OTHER STATE AND LOCAL 20 AGENCIES IN PRESENTING EDUCATIONAL PROGRAMS FOR PHYSICIANS AND 21 OTHER HEALTH PROFESSIONALS IN THE MOST UP-TO-DATE, ACCURATE SCI- 22 ENTIFIC AND MEDICAL INFORMATION ON OSTEOPOROSIS PREVENTION, DIAG- 23 NOSIS, AND TREATMENT, THERAPEUTIC DECISION-MAKING, INCLUDING 24 GUIDELINES FOR DETECTING AND TREATING THE DISEASE IN SPECIAL POP- 25 ULATIONS, RISKS AND BENEFITS OF MEDICATIONS, AND RESEARCH 26 ADVANCES. 01075'97 * 3 1 (4) AS PART OF THE PROGRAM ESTABLISHED UNDER SUBSECTION (1), 2 THE DEPARTMENT SHALL CONDUCT A STATEWIDE NEEDS ASSESSMENT TO 3 IDENTIFY 1 OR MORE OF THE FOLLOWING: 4 (A) AVAILABLE TECHNICAL ASSISTANCE AND EDUCATIONAL MATERIALS 5 AND PROGRAMS NATIONWIDE. 6 (B) THE LEVEL OF PUBLIC AND PROFESSIONAL AWARENESS ABOUT 7 OSTEOPOROSIS. 8 (C) THE NEEDS OF OSTEOPOROSIS PATIENTS AND OF THEIR FAMILIES 9 AND CAREGIVERS. 10 (D) NEEDS OF HEALTH CARE PROVIDERS. 11 (E) THE SERVICES AVAILABLE TO OSTEOPOROSIS PATIENTS. 12 (F) EXISTENCE OF OSTEOPOROSIS TREATMENT PROGRAMS. 13 (G) EXISTENCE OF OSTEOPOROSIS SUPPORT GROUPS. 14 (H) EXISTENCE OF OSTEOPOROSIS REHABILITATION SERVICES. 15 (I) NUMBER AND LOCATION OF BONE DENSITY TESTING EQUIPMENT. 16 (5) BASED ON THE NEEDS ASSESSMENT CONDUCTED UNDER SUBSECTION 17 (4), THE DEPARTMENT SHALL DEVELOP, MAINTAIN, AND MAKE AVAILABLE A 18 LIST OF OSTEOPOROSIS-RELATED SERVICES AND OSTEOPOROSIS HEALTH 19 CARE PROVIDERS WITH SPECIALIZATION IN SERVICES TO PREVENT, DIAG- 20 NOSE, AND TREAT OSTEOPOROSIS. 21 SEC. 9407. (1) IF OFFERED, THE DEPARTMENT SHALL ACCEPT FROM 22 THE STATE AND FEDERAL GOVERNMENTS AND OTHER PUBLIC AND PRIVATE 23 ENTITIES SERVICES AND PROPERTY AND FUNDS FOR DEPOSIT INTO THE 24 OSTEOPOROSIS EDUCATION FUND CREATED IN SECTION 9409. 25 (2) THE DEPARTMENT SHALL SEEK A FEDERAL WAIVER OR WAIVERS 26 NECESSARY TO MAXIMIZE FUNDS FROM THE FEDERAL GOVERNMENT TO 01075'97 * 4 1 IMPLEMENT THE OSTEOPOROSIS PREVENTION AND TREATMENT EDUCATION 2 PROGRAM. 3 SEC. 9409. (1) THE OSTEOPOROSIS EDUCATION FUND IS CREATED 4 IN THE STATE TREASURY. THE DEPARTMENT SHALL EXPEND THE FUND ONLY 5 TO CARRY OUT ITS DUTIES UNDER THIS PART. 6 (2) THE STATE TREASURER SHALL DEPOSIT IN THE FUND ALL MONEY 7 RECEIVED BY THE DEPARTMENT UNDER SECTION 9407 AND ALL MONEY 8 RECEIVED BY THE FUND AS OTHERWISE PROVIDED BY LAW. 9 (3) THE STATE TREASURER SHALL DIRECT THE INVESTMENT OF THE 10 FUND. INTEREST AND EARNINGS OF THE FUND SHALL BE CREDITED TO THE 11 FUND. MONEY IN THE FUND AT THE CLOSE OF THE FISCAL YEAR SHALL 12 REMAIN IN THE FUND AND SHALL NOT REVERT TO THE GENERAL FUND. 01075'97 * Final page. CPD
