CONTENT
The bill would amend the Michigan Vehicle Code to provide that if a person were convicted of a second drunk driving offense (operating a vehicle while under the influence of liquor or a controlled substance (OUIL); operating a vehicle while impaired due to the consumption of liquor or a controlled substance (OWI); or, for a person under 21 years of age, operating a vehicle if the person has any bodily alcohol content), the court would have to order the Secretary of State to issue a special sticker indicating that the vehicle's owner or operator had been convicted of a second violation. The court would have to issue this order in addition to allowing the Secretary of State to issue a restricted license.
The sticker would have to be in a form determined by the Secretary of State, color-coded in a color different from the registration plate, and affixed as determined by the Secretary of State. The sticker would have to remain on the registration plate for the duration of the license suspension or issuance of a restricted license, but not less than one year.

FISCAL IMPACT
The bill would result in increased administrative costs for the Department of State regarding issuance of a special sticker. No estimate has been provided by the Department. There are approximately 60,000 arrests annually for offenses covered by this bill in Michigan. Of that amount, an average of 33% are repeat offenders.
