A SUMMARY OF HOUSE BILLS 6280 AS INTRODUCED 11-5-98


House Bill 6280 would amend the Motor Carrier Safety Act to eliminate imprisonment as a kind of penalty for trucking safety violations. Currently the law reads that a violator of the act is guilty of a misdemeanor for each violation punishable by imprisonment for not more than 90 days or a fine of not more than $100, or both. However, those found guilty of violating the rules that govern transporting unsafe packages and hazardous materials are punished by a fine of not more than $500 for each violation, or by imprisonment for not more than 90 days, or both. House Bill 6280 would raise the $100 fine to $250, and further, the bill would eliminate the prison penalties, as well as the possibility of a monetary fine and a prison penalty.
