A SUMMARY OF HOUSE BILL 6113 AS INTRODUCED 9-17-98
House Bill 6113 would amend the Seller Disclosure Act to add two sections to the Seller's Disclosure Statement, a form that is required under current law during residential real estate transactions.
The Seller's Disclosure Statement provides space for the seller to state the most recent state equalized valuation of the property, and to specify the date. Under House Bill 6113, the form also would provide space for the seller to state the total number of property tax mills levied against the taxable value of the property.
In addition, under the bill, the form would contain a notice to advise buyers that information compiled pursuant to the Sex Offenders Registration Act is available by contacting the appropriate local law enforcement agency or sheriff's department. (The Sex Offenders Registration Act requires that convicted sex offenders be registered with the local law enforcement agencies in the jurisdictions where they live. A registration includes an offender's name, Social Security number, date of birth, address or expected address, a brief summary of convictions, a physical description, a recent photograph, and a blood type and an indication as to whether a DNA identification profile is available. Under the act, the Department of Corrections maintains a computerized data base of sex offenders. That compilation of individuals must be indexed numerically by zip code area, and must contain the name and aliases, address, physical description, and birth date of each individual registered, as well as any listed offense of which the individual has been convicted. A local law enforcement agency must make information from the compilation available for public inspection during regular business hours.)
