A SUMMARY OF HOUSE BILL 6091 AS INTRODUCED 9-16-98


The bill would amend the Revised Probate Code to include a provision requiring a guardian to be guided by the wishes of the ward that were expressed before the ward became legally incapacitated. This would include complying with a durable power of attorney or other advance directive. In addition, whenever meaningful communication was possible, the bill would require the guardian to consult with the ward before making a major decision affecting the ward.
