The bill would amend the Revised School Code to revise a new exemption from the Code’s compulsory public education requirement, by removing language requiring a home school educational program to be “appropriate”.
Currently, a child is not required to attend a public school if he or she is regularly attending and is being taught in a State-approved nonpublic school that teaches subjects comparable to those taught in the public schools to children of corresponding age and grade, as determined by the course of study for the public schools of the district within which the nonpublic school is located. In addition, under a provision of the Code that will take effect July 1, 1996, a child is not required to attend a public school if he or she is being educated by his or her parent, or legal guardian at the child’s home in an organized educational program that is appropriate given the child’s age, intelligence, ability, and psychological limitations, in the subject areas of reading, spelling, mathematics, science, history, civics, literature, writing, and English grammar. The bill would delete the language “that is appropriate given the age, intelligence, ability, and any psychological limitations of the child”.
The bill also would add that for a child being educated at the child’s home by his or her parent or legal guardian, the exemption from the requirement to attend public school could exist under either or both of the provisions described above.
